Baab Khareed O Farookht Ke Masail Ka Bayan

حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ اللَّهِ ، قَالَ : أَخْبَرَنِي اللَّيْثُ ، عَنْ سَعِيدٍ ، عَنْ أَبِيهِ ، عَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : سَمِعْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا ، ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ ، ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ فَتَبَيَّنَ زِنَاهَا فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ .

Urdu Translation

ہم سے عبدالعزیز بن عبداللہ نے بیان کیا، کہا کہ مجھے لیث نے خبر دی، انہیں سعید نے، انہیں ان کے والد نے، اور ان سے ابوہریرہ رضی اللہ عنہ نے بیان کیا کہ   رسول اللہ صلی اللہ علیہ وسلم سے میں نے خود سنا ہے کہ جب کوئی باندی زنا کرائے اور وہ ثابت ہو جائے تو اس پر حد زنا جاری کی جائے، البتہ اسے لعنت ملامت نہ کی جائے۔ پھر اگر وہ زنا کرائے تو اس پر اس مرتبہ بھی حد جاری کی جائے، لیکن کسی قسم کی لعنت ملامت نہ کی جائے۔ تیسری مرتبہ بھی اگر زنا کرے اور زنا ثابت ہو جائے تو اسے بیچ ڈالے خواہ بال کی ایک رسی کے بدلے ہی کیوں نہ ہو۔

English Translation

Narrated Abu Huraira: I heard the Prophet saying, If a slave-girl of yours commits illegal sexual intercourse and her illegal sexual intercourse is proved, she should be lashed, and after that nobody should blame her, and if she commits illegal sexual intercourse the second time, she should be lashed and nobody should blame her after that, and if she does the offense for the third time and her illegal sexual intercourse is proved, she should be sold even for a hair rope.
