حَدَّثَنَا مُسَدَّدٌ، ‏‏‏‏‏‏حَدَّثَنَا حَمَّادٌ، ‏‏‏‏‏‏عَنْ جَمِيلِ بْنِ مُرَّةَ، ‏‏‏‏‏‏عَنْ أَبِي الْوَضِيءِ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ غَزَوْنَا غَزْوَةً لَنَا فَنَزَلْنَا مَنْزِلًا، ‏‏‏‏‏‏فَبَاعَ صَاحِبٌ لَنَا فَرَسًا بِغُلَامٍ، ‏‏‏‏‏‏ثُمَّ أَقَامَا بَقِيَّةَ يَوْمِهِمَا وَلَيْلَتِهِمَا، ‏‏‏‏‏‏فَلَمَّا أَصْبَحَا مِنَ الْغَدِ حَضَرَ الرَّحِيلُ، ‏‏‏‏‏‏فَقَامَ إِلَى فَرَسِهِ يُسْرِجُهُ، ‏‏‏‏‏‏فَنَدِمَ فَأَتَى الرَّجُلَ وَأَخَذَهُ بِالْبَيْعِ، ‏‏‏‏‏‏فَأَبَى الرَّجُلُ أَنْ يَدْفَعَهُ إِلَيْهِ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ بَيْنِي وَبَيْنَكَ أَبُو بَرْزَةَ صَاحِبُ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَأَتَيَا أَبَا بَرْزَةَ فِي نَاحِيَةِ الْعَسْكَرِ، ‏‏‏‏‏‏فَقَالَا:‏‏‏‏ لَهُ هَذِهِ الْقِصَّةَ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ أَتَرْضَيَانِ أَنْ أَقْضِيَ بَيْنَكُمَا بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا ، ‏‏‏‏‏‏قَالَ هِشَامُ بْنُ حَسَّانَ:‏‏‏‏ حَدَّثَ جَمِيلٌ، ‏‏‏‏‏‏أَنَّهُ قَالَ:‏‏‏‏ مَا أَرَاكُمَا افْتَرَقْتُمَا.

Urdu Translation

ابوالوضی کہتے ہیں   ہم نے ایک جنگ لڑی ایک جگہ قیام کیا تو ہمارے ایک ساتھی نے غلام کے بدلے ایک گھوڑا بیچا، اور معاملہ کے وقت سے لے کر پورا دن اور پوری رات دونوں وہیں رہے، پھر جب دوسرے دن صبح ہوئی اور کوچ کا وقت آیا، تو وہ ( بیچنے والا ) اٹھا اور ( اپنے ) گھوڑے پر زین کسنے لگا اسے بیچنے پر شرمندگی ہوئی ( زین کس کر اس نے واپس لے لینے کا ارادہ کر لیا ) وہ مشتری کے پاس آیا اور اسے بیع کو فسخ کرنے کے لیے پکڑا تو خریدنے والے نے گھوڑا لوٹانے سے انکار کر دیا، پھر اس نے کہا: میرے اور تمہارے درمیان رسول اللہ صلی اللہ علیہ وسلم کے صحابی ابوبرزہ رضی اللہ عنہ موجود ہیں ( وہ جو فیصلہ کر دیں ہم مان لیں گے ) وہ دونوں ابوبرزہ رضی اللہ عنہ کے پاس آئے، اس وقت ابوبرزہ لشکر کے ایک جانب ( پڑاؤ ) میں تھے، ان دونوں نے ان سے یہ واقعہ بیان کیا تو انہوں نے ان دونوں سے کہا: کیا تم اس بات پر راضی ہو کہ میں تمہارے درمیان رسول اللہ صلی اللہ علیہ وسلم کے فیصلہ کے مطابق فیصلہ کر دوں؟ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا ہے: دونوں خرید و فروخت کرنے والوں کو اس وقت تک بیع فسخ کر دینے کا اختیار ہے، جب تک کہ وہ دونوں ( ایک مجلس سے ) جدا ہو کر ادھر ادھر نہ ہو جائیں ۔ ہشام بن حسان کہتے ہیں کہ جمیل نے بیان کیا ہے کہ انہوں نے کہا: میں سمجھتا ہوں کہ تم دونوں جدا نہیں ہوئے ہو ۱؎۔

English Translation

Narrated Abu lWadi: We fought one of our battle, and encamped at a certain place. One of our companions sold a horse for a slave. After that they remained there for the rest of day and night. When the next morning came, they prepared themselves for departure. The buyer of the horse began to saddle it, but the seller was ashamed (of the transaction). He went to the man (buyer) and asked him to annul the transaction. The man refused to hand it over (the horse) to him. He said: Abu Barzah, the companion of the Prophet صلی ‌اللہ ‌علیہ ‌وسلم, is to decide between me and you. They went to Abu Barzah in the corner of the army. They related this story to him. He said: Do you agree that I make a decision between you on the basis of the decision of the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم? The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم said: Both parties in a business transaction have an option (right) to annul it so long as they have not separated. Hisham to Hassan said that Jamil said in his version: I do not think that you separated.
