حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، ‏‏‏‏‏‏حَدَّثَنَا إِسْمَاعِيل بْنُ إِبْرَاهِيمَ، ‏‏‏‏‏‏عَنِ ابْنِ جُرَيْجٍ، ‏‏‏‏‏‏عَنْ أَبِي الزُّبَيْرِ، ‏‏‏‏‏‏عَنْ جَابِرٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ الشُّفْعَةُ فِي كُلِّ شِرْكٍ رَبْعَةٍ أَوْ حَائِطٍ لَا يَصْلُحُ أَنْ يَبِيعَ حَتَّى يُؤْذِنَ شَرِيكَهُ، ‏‏‏‏‏‏فَإِنْ بَاعَ فَهُوَ أَحَقُّ بِهِ حَتَّى يُؤْذِنَهُ .

Urdu Translation

جابر رضی اللہ عنہ کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: شفعہ ۱؎ ہر مشترک چیز میں ہے، خواہ گھر ہو یا باغ کی چہار دیواری، کسی شریک کے لیے درست نہیں ہے کہ وہ اسے اپنے شریک کو آگاہ کئے بغیر بیچ دے، اور اگر بغیر آگاہ کئے بیچ دیا تو شریک اس کے لینے کا زیادہ حقدار ہے یہاں تک کہ وہ اسے دوسرے کے ہاتھ بیچنے کی اجازت دیدے ۲؎ ۔

English Translation

Narrated Jabir: The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم as saying: There is the right of option regarding everything which is shared, whether a dwelling or a garden. It is not lawful to sell before informing one's partner, but if he sells without informing him, he has the greatest right to it.
