حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، ‏‏‏‏‏‏حَدَّثَنَا أَبُو دَاوُدَ هُوَ الطَّيَالِسِيُّ، ‏‏‏‏‏‏حَدَّثَنَا ابْنُ أَبِي ذِئْبٍ، ‏‏‏‏‏‏عَنْ أَبِي الْمُعْتَمِرِ، ‏‏‏‏‏‏عَنْ عُمَرَ بْنِ خَلْدَةَ، ‏‏‏‏‏‏قَال:‏‏‏‏ أَتَيْنَا أَبَا هُرَيْرَةَ، ‏‏‏‏‏‏فِي صَاحِبٍ لَنَا أَفْلَسَ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ لَأَقْضِيَنَّ فِيكُمْ بِقَضَاءِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَنْ أَفْلَسَ أَوْ مَاتَ فَوَجَدَ رَجُلٌ مَتَاعَهُ بِعَيْنِهِ فَهُوَ أَحَقُّ بِهِ .

Urdu Translation

عمر بن خلدہ کہتے ہیں   ہم اپنے ایک ساتھی کے مقدمہ میں جو مفلس ہو گیا تھا ابوہریرہ رضی اللہ عنہ کے پاس آئے، انہوں نے کہا: میں تمہارا فیصلہ رسول اللہ صلی اللہ علیہ وسلم کے فیصلہ کے مطابق کروں گا، آپ صلی اللہ علیہ وسلم نے فرمایا ہے: جو مفلس ہو گیا، یا مر گیا، اور بائع نے اپنا مال اس کے پاس بعینہ موجود پایا تو وہ بہ نسبت اور قرض خواہوں کے اپنا مال واپس لے لینے کا زیادہ حقدار ہے ۔

English Translation

Umar ibn Khaldah said: We came to Abu Hurairah who had become insolvent. He said: I shall decide between you on the basis of the decision of the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم: If anyone becomes insolvent or dies and the man (the seller) finds his very property with him, he is more entitled to it (than others).
