حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، ‏‏‏‏‏‏حَدَّثَنَا عَبْدُ الرَّزَّاقِ، ‏‏‏‏‏‏أَخْبَرَنَا مَعْمَرٌ، ‏‏‏‏‏‏عَنِ الزُّهْرِيِّ، ‏‏‏‏‏‏عَنْ أَبِي سَلَمَةَ، ‏‏‏‏‏‏عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ إِنَّمَا الْعُمْرَى الَّتِي أَجَازَهَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَقُولَ:‏‏‏‏ هِيَ لَكَ وَلِعَقِبِك، ‏‏‏‏‏‏فَأَمَّا إِذَا قَالَ:‏‏‏‏ هِيَ لَكَ مَا عِشْتَ فَإِنَّهَا تَرْجِعُ إِلَى صَاحِبِهَا .

Urdu Translation

جابر بن عبداللہ رضی اللہ عنہما کہتے ہیں   جس عمریٰ کی رسول اللہ صلی اللہ علیہ وسلم نے اجازت دی ہے وہ ہے کہ دینے والا کہے کہ یہ تمہاری اور تمہاری اولاد کی ہے ( تو اس میں وراثت جاری ہو گی اور دینے والے کی ملکیت ختم ہو جائے گی ) لیکن اگر دینے والا کہے کہ یہ تمہارے لیے ہے جب تک تم زندہ رہو ( تو اس سے استفادہ کرو ) تو وہ چیز ( اس کے مرنے کے بعد ) اس کے دینے والے کو لوٹا دی جائے گی۔

English Translation

Narrated Jabir bin Abdullah: The life-tenancy which the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم allowed was only that one should say: It is for you and your descendants. When he says: It is yours as long as you live, it returns to its owner.
