Fatimah daughter of Qais said “I was married to a man of Banu Makhzum. He divorced me absolutely. The narrator then transmitted the rest of the tradition like that of Malik. This version has “Do not marry yourself without my permission. ” Abu Dawud said Al Shabi, Al Bahiyy and ata from abd Al Rahman bin asim and Abu Bakr bin Abi Al Jahm all narrated on the authority of Fatimah daughter of Qais that her husband had divorced her three times.

حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، ‏‏‏‏‏‏عَنْ إِسْمَاعِيلَ بْنِ جَعْفَرٍ، ‏‏‏‏‏‏عَنْ مُحَمَّدِ بْنِ عَمْرٍو، ‏‏‏‏‏‏عَنْ أَبِي سَلَمَةَ، ‏‏‏‏‏‏عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ، ‏‏‏‏‏‏قَالَتْ:‏‏‏‏ كُنْتُ عِنْدَ رَجُلٍ مِنْ بَنِي مَخْزُومٍ فَطَلَّقَنِي الْبَتَّةَ، ‏‏‏‏‏‏ثُمَّ سَاقَ نَحْوَ حَدِيثِ مَالِكٍ، ‏‏‏‏‏‏قَالَ فِيهِ:‏‏‏‏ وَلَا تُفَوِّتِينِي بِنَفْسِكِ . قَالَ أَبُو دَاوُد:‏‏‏‏ وَكَذَلِكَ رَوَاهُ الشَّعْبِيُّ وَ الْبَهِيُّ وَ عَطَاءٌ، ‏‏‏‏‏‏عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَاصِمٍ وَ أَبُو بَكْرِ بْنِ أَبِي الْجَهْمِ، ‏‏‏‏‏‏كُلُّهُمْ عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ، ‏‏‏‏‏‏أَنَّ زَوْجَهَا طَلَّقَهَا ثَلَاثًا.

فاطمہ بنت قیس رضی اللہ عنہا کہتی ہیں کہ   میں قبیلہ بنی مخروم کے ایک شخص کے نکاح میں تھی اس نے مجھے طلاق بتہ دے دی، پھر راوی نے مالک کی حدیث کے مثل حدیث بیان کی اس میں «ولا تفوتيني بنفسك» ہے۔ ابوداؤد کہتے ہیں: اسی طرح اسے شعبی اور بہی نے اور عطاء نے بواسطہ عبدالرحمٰن بن عاصم اور ابوبکر بن جہم اور سبھوں نے فاطمہ بنت قیس رضی اللہ عنہا سے روایت کیا ہے کہ انہیں ان کے شوہر نے تین طلاق دی ( نہ کہ طلاق بتہ ) ۔
