Sunan Abu Dawood 3509 - Wages (Kitab Al-Ijarah)

حَدَّثَنَا مَحْمُودُ بْنُ خَالِدٍ، ‏‏‏‏‏‏عَنْ سُفْيَانَ، ‏‏‏‏‏‏عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ، ‏‏‏‏‏‏عَنْ مَخْلَدِ بْنِ خُفَافٍ الْغِفَارِيِّ، ‏‏‏‏‏‏قَال:‏‏‏‏ كَانَ بَيْنِي وَبَيْنَ أُنَاسٍ شَرِكَةٌ فِي عَبْدٍ فَاقْتَوَيْتُهُ، ‏‏‏‏‏‏وَبَعْضُنَا غَائِبٌ فَأَغَلَّ عَلَيَّ غَلَّةً فَخَاصَمَنِي فِي نَصِيبِهِ إِلَى بَعْضِ الْقُضَاةِ، ‏‏‏‏‏‏فَأَمَرَنِي أَنْ أَرُدَّ الْغَلَّةَ، ‏‏‏‏‏‏فَأَتَيْتُ عُرْوَةَ بْنَ الزُّبَيْرِ فَحَدَّثْتُهُ، ‏‏‏‏‏‏فَأَتَاهُ عُرْوَةُ فَحَدَّثَهُ، ‏‏‏‏‏‏عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا، ‏‏‏‏‏‏عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ الْخَرَاجُ بِالضَّمَانِ .

Urdu Translation

مخلد بن خفاف) غفاری کہتے ہیں   میرے اور چند لوگوں کے درمیان ایک غلام مشترک تھا، میں نے اس غلام سے کچھ کام لینا شروع کیا اور ہمارا ایک حصہ دار موجود نہیں تھا اس غلام نے کچھ غلہ کما کر ہمیں دیا تو میرا شریک جو غائب تھا اس نے مجھ سے جھگڑا کیا اور معاملہ ایک قاضی کے پاس لے گیا، اس قاضی نے مجھے حکم دیا کہ میں اس کے حصہ کا غلہ اسے دے دوں، پھر میں عروہ بن زبیر رضی اللہ عنہ کے پاس آیا اور ان سے اسے بیان کیا، تو عروہ رضی اللہ عنہ ان کے پاس آئے اور ان سے وہ حدیث بیان کی جو انہوں نے ام المؤمنین عائشہ رضی اللہ عنہا سے اور عائشہ رضی اللہ عنہا نے رسول اللہ صلی اللہ علیہ وسلم سے روایت کی تھی آپ نے فرمایا: منافع اس کا ہو گا جو ضامن ہو گا ۱؎ ۔

English Translation

Narrated Makhlad ibn Khufaf al-Ghifari: I and some people were partners in a slave. I employed him on some work in the absence of one of the partners. He got earnings for me. He disputed me and the case of his claim to his share in the earnings to a judge, who ordered me to return the earnings (i. e. his share) to him. I then came to Urwah ibn az-Zubayr, and related the matter to him. Urwah then came to him and narrated to him a tradition from the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم on the authority of Aishah: Profit follows responsibility.
