Everybody is well knowing in the world about the factual constitutional position of the territory of Kashmir at both sides of Pakistan and India known as Azad Kashmir (inside the line of control with Pakistan) and Occupied Kashmir or Indian Held Kashmir (IHK) at the other side of line of control with India). Many articles have been written on this topic in national and international journals published now a day in both the countries and leading international newspapers and journals of various states. This topic is always remained under discussion at media.
Till to date it is very clear that after the partition of Indo-Pak subcontinent since August 1947, Kashmir is a undecided, outstanding and disputed issue between both the states which is still pending for solution according to the vote of self-determination and independence of the people of Kashmir. Four wars (1947, 1965, 1971 and 1999) have been fought between both the states since independence. Matter had already been put forwarded in UN Security Council and according to their resolution, decision regarding Kashmir for its having part of India or Pakistan is to be taken and decided by vote of self-determination of the Kashmiries while India is not giving them this right.
It is also clear to world community that population of Indian held Kashmir is Muslim for more than their 80% of total population. People of Kashmir are fighting for their this right for last more than 70 years and during their prolong struggle of independence from Indian occupation, more than one lac innocent people including student, most of young population, ladies children scholars, lawyers, professors, doctors and engineers have been martyred in different terror activities of Indian army, spread all over the valley to curb the movement of independence.
Thousands of young men have been put into various jails of valley from a long period without any suite. The whole valley has been converted into vast jail. Basic human rights have been over ruled. Now a day communication and internet media services remained closed to disconnect the valley from rest of the world to keep unaware the international media about struggle of locals for their stand and stance of independence and state terrorism. Neither the International NGO working for human rights nor the UNO Military Observers are permitted to send their vigilantes inside the Occupied Kashmir for their observations and expert opinion on the current situation.
Special arrangement have been made and promoted by the Indian government to permit Non-Muslim population to stay in the valley and expand their business in order to change the percentage ratio of Muslim majority in the valley. Beside this, young Muslims are being killed or put in prison to reduce their population. A large number of Indian armed forces with air and logistic support have been deployed in the valley which is being increased now a day to undertake any adventure in the valley. Number of border violation are increased by Indian army at LOC with firing of heavy weapons from their posts at civilian population, travelers, tourists, farmers and school going children inside the Azad Kashmir along the LOC. Such incidents are being reported in media regularly and Indian high commissioner is called in foreign office to record the protest.
Recently cluster and toy bombs have been used by Indian army from LOC at civilian population of AK resultantly many citizens including children have been killed. It may be noted that Cluster bombs are banned and prohibited by after 2010 (Convention on Cluster Munitions (CCM a disarmament treaty adopted on 30 May 2008 in Dublin and signed on 3 December 2010 in Oslo) and use of banned weapons is a serious violation of International laws framed by UNO disarmament and peace process.
Now Indian government has taken a strange step to change the constitutional status of Kashmir by revoking relevant Article from their constitution known as 370. Article 370 of the Indian constitution provide special status to the region of Jammu and Kashmir, allowing it to have a separate constitution, a state flag and autonomy over the internal administration of the state This article, along with Article 35A, further defined that the Jammu and Kashmir state's residents can live under a separate set of laws, which includes laws concerning to citizenship, ownership of land and property, and fundamental rights, as compared and equal to resident of other Indian states. Under the provision of this rule, Indian citizens from other states of India, could not purchase land or property in Jammu & Kashmir.
On 5 August 2019, the President of India Mr. Ram Nath Kovind issued a constitutional order revoking the 1954 order (Article 370 and 35 A), He issued a further order on 6 August declaring all the clauses of Article 370 to be inoperative. Further, the Jammu and Kashmir Re-organization Bill has been passed in both the houses of Parliament, which divided the state of Jammu and Kashmir into two union territories to be called Jammu and Kashmir and Ladakh.
Movement of this bill has changed the original and existing status of Jammu and Kashmir and now they are considering it as a part of their state instead of its undecided, disputed and pending status between both the countries under the resolution passed by the UNO’s Security Council which were in favour of the people of Jammu & Kashmir. This unlawful act of Indian government is itself a serious violation of UNO's resolutions and Simla Agreement. At the other hand, this had changed the entire security situation along the both sides of LOC.
The entire opposition in Indian parliament is against this act of their government. Beside this, civil societies, NGO in India and some journalists are raising their voice against this bill. Former Chief Ministers of Occupied Kashmir, Umer Abdullah and Mehbooba Mufti have been arrested along with other more than 600 freedom leaders of valley during last 5 days. People of the valley are facing curfew for last one week. The entire community of IHK, AK , Pakistan and Kashmiri community spread all over the world are at protest in various gatherings and relies against this unlawful act of Moodi government and their state terrorism in IHK.
After this Pakistan has few options to defend the rights of Kashmiri Community.
Common session of both the parliament has been summoned where all political parties of opposition, government and military leadership are at one page standing along the innocent Kashmiri people in support of their great cause where following concrete decision have been taken:-
a. Case of Kashmir be put forwarded to UNO's Security Council for its solutions according to their recommendations and resolutions.
b. Case of Kashmir be filed in International Court of Justice.
c. Matter be discussed at the plate form of OIC.
d. Dirty face of Moodi, its government and BJP be exposed with rest of the world through strong diplomatic relations with other countries especially great powers and brother Muslim countries. Letters have been written to few countries and tele conversation exchanged by MOFA of Pakistan. Foreign Minister is also visiting some countries to discuss the current situation with their counterparts.
e. Bilateral diplomatic relations be restricted with India including business ties, trade and commercial relations and people to people contacts. Samjhota Express (Train service between both countries) has also been discontinued.
f. Indian Military activities and border violations be monitored actively and proper strict action be taken by Pak Army to tackle the situation with zero tolerance.
This is all about which is being done by the state and state departments but a lot of actions have to be taken by the other public of Pakistan against India to stand with Kashmiri community to defend the Kashmir cause. Few are categorically suggested here under:-
a. Electronic and Print Media to publish and broadcast a series of programmes frequently in which Kashmir issue be highlighted in Urdu and Foreign languages to raise a strong voice to defend the right of independence of Kashmiris. All channels of TV and Radio and leading newspapers to make special efforts in this regard.
b. Original text and documentary related to Simla Agreement (2 July 1972) and resolution of Security Council of UNO (resolution No. 47 dated 21 April 1948) regarding solution of Kashmir issue be published and broadcasted for the information of general public and students to defend the case of Kashmir.
c. Our writers, poets and journalists to play a positive role and to show power of pen in favour of this struggle for freedom, which is now at its peak.
d. General public and social media users to stop browsing Indian channels at You Tubes and their other channels on internet including their cultural films and dramas which are at one side painting a negative picture of freedom fighter in Kashmir and at the other hand, they are earning a heavy amounts and expanding their this business through these channels. Instead of this, struggle of freedom fighters in Kashmir and their history and culture related posts be promoted at social media.
e. This movement of Kashmiri people be introduced and taught to students of all levels by organizing and launching various quiz programmes, debates, declamations and cultural programmes related to Kashmiri customs and civilizations at schools, colleges and Universities. Education department of all the provinces should include sufficient matter in the syllabus of different levels consisting of Maps of Occupied Kashmir, short introduction to the major cities of Kashmir having Muslim majority with related information to their history, geography and culture and various phases of movement of Kashmiri peoples for their independence.
f. Special exhibitions be arranged to promote and introduce real Kashmiri culture by keep their Art, Handicrafts, documentaries related to geography, history and culture, literature and special movies and plays showing struggle of people for their independence and Indian Army’s actions and terrorism against this movement. Portraits of prominent leaders with their short introductions. Such programmes be arranged by the Ministry of Culture and Kashmir Affairs with cooperation of Government of AK in various cities.
At the end of this article, it is worth mentioning that Kashmir is only for Kashmiris, and its only and better solution is table talk according to the resolutions of Security Council of UNO which should be at least accepted by Indian government. More than 80% having Muslim community is tied with Pakistan from its border, culture, history, civilization, way of living and worship. All rivers and streams of Pakistan are coming from Kashmir. Great powers especially US, UK, China, Rusia France and OIC should built a pressure through their diplomatic chains on India to accept the truth and to face the rights of the Kashmir recommended by SC of UNO so that a positive and viable solution be done instead of a fifth and LAST war between both the nuclear armed states. As there will be nothing remain to discuss with both the countries once nuclear war is started which will be ultimately ended with mass destruction of mankind, other creatures and infrastructures.
It is the time to decide for BJP and Moodi government as peace of this region is in their hand only if Kashmir issue is resolved according to the will and vote of self-determination which is already recommended by SC of UNO in its resolutions. It is added that India has already testified this nation on 27 February at LOC with loss of its planes and arrest of piolets (in military action) and secondly at International Forum in case of Kulbhushan Yadav as a defeat at International Court of Justice Hague (in an advocacy and wisdom action).
So once again, there is a sincere advice for Moodi regime, not to repeat such practices and come on table to solve the issue in the presence of some intermediator from international community or bilaterally as per the directives of UNO.
