JUDICIARY UNDER THREAT-II

In continuation of my previous content, the sole object of presenting Affidavit in public to gain little fame and demoralize judiciary. Now, the Ex-chief Justice Gilgit Baltistan, have argued in last proceeding, I could not aware leaking of Affidavit. The original Affidavit kept in safe custody in office, London, UK. It is ridiculous. What a joke with judiciary. Why Mr. Rana Shamim, ex-Chief Justice write this type of affidavit? Who said to do this? Why Ex-Chief Justice of GB delays to explain his position as well as and hide incident from public? Islamabad High Court has given one week time to Ex-chief justice to explain his position. If he fails to produce original affidavit in court then Court can punish according to law. The maximum punishment in contempt cases 6 month imprisonment and fine Rs.5000/- or both.

“Equity aids the vigilant not the indolent.” In this regard the petitioner should vigilant to get justice in time. Tone of the critics is good upon judiciary but blame is not acceptable. Delay defeats the equity. It is crystal clear. This case is best example to fulfill requirements of this maximum. The common people always critics upon judiciary but it is not up to the right mark. According to my presumption about critics upon judiciary is misunderstanding of laws. As far as precedent of the apex court of Pakistan is clear regarding critics is always welcome but blame is not acceptable. The pillar of justice is standing upon evidence. No one deny this important in any manner. Our judiciary is also adhering rule of law.

No, one above the law. No, one say, I am immune from law. On the other hand, presumption, it is totally different thing because people are neither lawyers nor judge even less knowledge of laws. The judges are not deciding any case on basis of presumptions and it will not decide on will of others. The judges has bound to adhering rule of law and decide any case in the light of available evidences.

The judges are expert of laws and deep knowledge of social norms and keep analytical view of the cases. In Indian and Pakistani societies always blame upon judiciary they are taking bribes and releasing criminals but it not true. The judges are observing prima facie case and decide according to reliable evidence and statements of witness. However, the cross examine is good sources to bring truth in front of public and prosecution assistance to court to decide any matter according to reliable evidences.

If you trying to disrespect judiciary it means you are not loyal with your states. This trend and mindset of public should change and help judiciary with truth and evidences. There are hundreds of minors rape cases are pending in various courts and waiting for strong evidence which is not available due to fear from judicial enquiry and accountability.

In spite of all this, the healthy critics are always welcome by the judiciary. The object of any critics should clear in minds before imposing any blame upon judiciary. We should amend our ways according to law and finds solution of our major problems
