Justice Delayed is Justice Denied

"Justice delayed is justice denied" is a legal maxim meaning that if legal redress is available for a party that has suffered some injury, but is not forthcoming in a timely fashion, it is effectively the same as having no redress at all. This principle is the basis for the right to a speedy trial and similar rights which are meant to expedite the legal system, because it is unfair for the injured party to have to sustain the injury with little hope for resolution. The phrase has become a rallying cry for legal reformers who view courts acting too slowly in resolving legal issues either because the existing system is too complex or overburdened, or because the issue or party in question lacks political favor.

In the regime of former president Pervez Musharraf, Present Chief justice Iftikhar Chaudary was sacked twice from his office in march 2007 and in November 2007 and then he was restored in the government of Pakistan people’s party by an announcement made by prime minister Yousuf Raza Gillani on 16th March 2009, the people and the nation of Pakistan has played a significant role in the restoration of Judiciary.

After the restoration chief justice emerged as the last hope for the nation of Pakistan that he will provide nation a sigh of relief from the problems like load shedding, high prices, unstable demand and supply of items and target killing but eventually the people of Pakistan has only suffered between the gimmick of executive and judiciary. Both the organs of state has made astonishing stunts to grab the attention of public and to take active part in the next days newspaper’s headline. Majority of suo motos actions resulted in futility by providing no proper remedies to the poor people of Pakistan as example target killing case in Karachi.

Unfortunately the people of Pakistan are not so intelligent and intellectual or enough capable that they may realize the correct situation that weather the judiciary is the part of the gimmick or truly acting on the legal phrase ‘justice delayed is justice denied’

Today we are hearing about the MEMO scandal case and the swiss bank charges upon the leadership of the Pakistan peoples party but the fact is that nothing has been proven in this regard and the cases are still pending in the prima facie. The leadership of Pakistan peoples is still enjoying the position of innocent due to prima facie (innocent until proven guilty) because the charges has no value in the eye of law.
 
If there is some reality in charges so the supreme court should take some speedy trials to debunk this charged government and to provide relief to the people of Pakistan.

The nation is hoping of some overwhelming decision on 16th of January.
