حَدَّثَنَا يُوسُفُ بْنُ عِيسَى، حَدَّثَنَا وَكِيعٌ، حَدَّثَنَا عَبْدُ الْحَمِيدِ بْنُ جَعْفَرٍ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ، عَنْ مَرْثَدِ بْنِ عَبْدِ اللَّهِ الْيَزَنِيِّ أَبِي الْخَيْرِ، عَنْ عُقْبَةَ بْنِ عَامِرٍ الْجُهَنِيِّ، قَالَ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ إِنَّ أَحَقَّ الشُّرُوطِ أَنْ يُوفَى بِهَا مَا اسْتَحْلَلْتُمْ بِهِ الْفُرُوجَ . حَدَّثَنَا أَبُو مُوسَى مُحَمَّدُ بْنُ الْمُثَنَّى، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ عَبْدِ الْحَمِيدِ بْنِ جَعْفَرٍ نَحْوَهُ. قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏مِنْهُمْ عُمَرُ بْنُ الْخَطَّابِ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ إِذَا تَزَوَّجَ رَجُلٌ امْرَأَةً وَشَرَطَ لَهَا أَنْ لَا يُخْرِجَهَا مِنْ مِصْرِهَا فَلَيْسَ لَهُ أَنْ يُخْرِجَهَا، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ بَعْضِ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏وَبِهِ يَقُولُ:‏‏‏‏ الشَّافِعِيُّ، ‏‏‏‏‏‏وَأَحْمَدُ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏وَرُوِي عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ، ‏‏‏‏‏‏أَنَّهُ قَالَ:‏‏‏‏ شَرْطُ اللَّهِ قَبْلَ شَرْطِهَا كَأَنَّهُ رَأَى لِلزَّوْجِ أَنْ يُخْرِجَهَا وَإِنْ كَانَتِ اشْتَرَطَتْ عَلَى زَوْجِهَا أَنْ لَا يُخْرِجَهَا، ‏‏‏‏‏‏وَذَهَبَ بَعْضُ أَهْلِ الْعِلْمِ إِلَى هَذَا، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ سُفْيَانَ الثَّوْرِيِّ، ‏‏‏‏‏‏وَبَعْضِ أَهْلِ الْكُوفَةِ.

Urdu Translation

عقبہ بن عامر جہنی رضی الله عنہ کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”سب سے زیادہ پوری کیے جانے کی مستحق وہ شرطیں ہیں جن کے ذریعے تم نے شرمگاہیں حلال کی ہوں“۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- صحابہ کرام میں سے بعض اہل علم کا اسی پر عمل ہے۔ انہیں میں عمر بن خطاب بھی ہیں، وہ کہتے ہیں کہ جب کسی شخص نے کسی عورت سے شادی کی اور یہ شرط لگائی کہ وہ اسے اس کے شہر سے باہر نہیں لے جائے گا تو اس کے لیے جائز نہیں کہ وہ اسے باہر لے جائے، یہی بعض اہل علم کا قول ہے۔ اور شافعی، احمد اور اسحاق بن راہویہ بھی اسی کے قائل ہیں، ۳- البتہ علی بن ابی طالب سے مروی ہے کہ انہوں نے کہا: اللہ کی شرط یعنی اللہ کا حکم عورت کی شرط پر مقدم ہے، گویا ان کی نظر میں شوہر کے لیے اسے اس کے شہر سے باہر لے جانا درست ہے اگرچہ اس نے اپنے شوہر سے اسے باہر نہ لے جانے کی شرط لگا رکھی ہو، اور بعض اہل علم اس جانب گئے ہیں اور یہی سفیان ثوری اور بعض اہل کوفہ کا بھی قول ہے۔

English Translation

Uqbah bin Amir Al-Juhani narrated that: The Messenger of Allah said: Indeed the conditions most deserving to be fulfilled are those that make the private parts lawful among you.
