حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا قَبِيصَةُ، عَنْ جَرِيرِ بْنِ حَازِمٍ، عَنْ الزُّبَيْرِ بْنِ سَعِيدٍ، عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ بْنِ رُكَانَةَ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، قَالَ:‏‏‏‏ أَتَيْتُ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَقُلْتُ:‏‏‏‏ يَا رَسُولَ اللَّهِ، ‏‏‏‏‏‏إِنِّي طَلَّقْتُ امْرَأَتِيَ الْبَتَّةَ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ مَا أَرَدْتَ بِهَا ؟ قُلْتُ:‏‏‏‏ وَاحِدَةً، ‏‏‏‏‏‏قَالَ:‏‏‏‏ وَاللَّهِ ؟ قُلْتُ:‏‏‏‏ وَاللَّهِ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ فَهُوَ مَا أَرَدْتَ . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ لَا نَعْرِفُهُ، ‏‏‏‏‏‏إِلَّا مِنْ هَذَا الْوَجْهِ، ‏‏‏‏‏‏وَسَأَلْتُ مُحَمَّدًا عَنْ هَذَا الْحَدِيثِ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ فِيهِ اضْطِرَابٌ وَيُرْوَى، ‏‏‏‏‏‏عَنْ عِكْرِمَةَ، ‏‏‏‏‏‏عَنْ ابْنِ عَبَّاسٍ، ‏‏‏‏‏‏أَنَّ رُكَانَةَ طَلَّقَ امْرَأَتَهُ ثَلَاثًا، ‏‏‏‏‏‏وَقَدِ اخْتَلَفَ أَهْلُ الْعِلْمِ، ‏‏‏‏‏‏مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ فِي طَلَاقِ الْبَتَّةِ، ‏‏‏‏‏‏فَرُوِيَ عَنْ عُمَرَ بْنِ الْخَطَّابِ، ‏‏‏‏‏‏أَنَّهُ جَعَلَ الْبَتَّةَ وَاحِدَةً وَرُوِيَ، ‏‏‏‏‏‏عَنْ عَلِيٍّ أَنَّهُ جَعَلَهَا ثَلَاثًا، ‏‏‏‏‏‏وقَالَ بَعْضُ أَهْلِ الْعِلْمِ:‏‏‏‏ فِيهِ نِيَّةُ الرَّجُلِ، ‏‏‏‏‏‏إِنْ نَوَى وَاحِدَةً فَوَاحِدَةٌ، ‏‏‏‏‏‏وَإِنْ نَوَى ثَلَاثًا فَثَلَاثٌ، ‏‏‏‏‏‏وَإِنْ نَوَى ثِنْتَيْنِ لَمْ تَكُنْ إِلَّا وَاحِدَةً، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ الثَّوْرِيِّ، ‏‏‏‏‏‏وَأَهْلِ الْكُوفَةِ، ‏‏‏‏‏‏وقَالَ:‏‏‏‏ مَالِكُ بْنُ أَنَسٍ فِي الْبَتَّةِ:‏‏‏‏ إِنْ كَانَ قَدْ دَخَلَ بِهَا فَهِيَ ثَلَاثُ تَطْلِيقَاتٍ، ‏‏‏‏‏‏وقَالَ الشَّافِعِيُّ:‏‏‏‏ إِنْ نَوَى وَاحِدَةً فَوَاحِدَةٌ يَمْلِكُ الرَّجْعَةَ، ‏‏‏‏‏‏وَإِنْ نَوَى ثِنْتَيْنِ فَثِنْتَانِ، ‏‏‏‏‏‏وَإِنْ نَوَى ثَلَاثًا فَثَلَاثٌ.

Urdu Translation

رکانہ رضی الله عنہ کہتے ہیں کہ   میں نے نبی اکرم صلی اللہ علیہ وسلم کے پاس آ کر عرض کیا: اللہ کے رسول! میں نے اپنی بیوی کو قطعی طلاق ( بتّہ ) دی ہے۔ آپ نے فرمایا: ”تم نے اس سے کیا مراد لی تھی؟“، میں نے عرض کیا: ایک طلاق مراد لی تھی، آپ نے پوچھا: ”اللہ کی قسم؟“ میں نے کہا: اللہ کی قسم! آپ نے فرمایا: ”تو یہ اتنی ہی ہے جتنی کا تم نے ارادہ کیا تھا“۔ امام ترمذی کہتے ہیں: ۱- اس حدیث کو ہم صرف اسی طریق سے جانتے ہیں، ۲- میں نے محمد بن اسماعیل بخاری سے اس حدیث کے بارے میں پوچھا تو انہوں نے کہا: اس میں اضطراب ہے، عکرمہ سے روایت ہے کہ ابن عباس رضی الله عنہما کہتے ہیں رکانہ نے اپنی بیوی کو تین طلاقیں دی تھیں، ۳- اہل علم صحابہ کرام وغیرہم میں سے عمر بن خطاب رضی الله عنہ سے مروی ہے کہ انہوں نے طلاق بتہ کو ایک طلاق قرار دی ہے، ۴- اور علی رضی الله عنہ سے مروی ہے انہوں نے اسے تین طلاق قرار دی ہے، ۵- بعض اہل علم کہتے ہیں کہ اس سلسلے میں آدمی کی نیت کا اعتبار ہو گا۔ اگر اس نے ایک کی نیت کی ہے تو ایک ہو گی اور اگر تین کی کی ہے تو تین ہو گی۔ اور اگر اس نے دو کی نیت کی ہے تو صرف ایک شمار ہو گی۔ یہی ثوری اور اہل کوفہ کا قول ہے، ۶- مالک بن انس قطعی طلاق ( بتّہ ) کے بارے میں کہتے ہیں کہ اگر عورت ایسی ہے کہ اس کے ساتھ دخول ہو چکا ہے تو طلاق بتّہ تین طلاق شمار ہو گی، ۷- شافعی کہتے ہیں: اگر اس نے ایک کی نیت کی ہے تو ایک ہو گی اور اسے رجعت کا اختیار ہو گا۔ اگر دو کی نیت کی ہے تو دو ہو گی اور اگر تین کی نیت کی ہے تو تین شمار ہو گی۔

English Translation

Abdullah bin Yazid bin Rukanah narrated from his father, from his grandfather who said: 'O Messenger of Allah! I irrevocably divorced my wife.' So he said: 'What did you intend by that?' I said: 'One (divorce).' He said: '(Do you swear) By Allah?' I said: 'By Allah.' He said: 'Then it is as you intended.'
