حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنْ نَافِعٍ، عَنْ ابْنِ عُمَرَ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ نَهَى عَنْ بَيْعِ حَبَلِ الْحَبَلَةِ . قَالَ:‏‏‏‏ وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ عَبْدِ اللَّهِ بْنِ عَبَّاسٍ، ‏‏‏‏‏‏وَأَبِي سَعِيدٍ الْخُدْرِيِّ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ ابْنِ عُمَرَ حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏وَحَبَلُ الْحَبَلَةِ نِتَاجُ النِّتَاجِ وَهُوَ بَيْعٌ مَفْسُوخٌ عِنْدَ أَهْلِ الْعِلْمِ وَهُوَ مِنْ بَيُوعِ الْغَرَرِ، ‏‏‏‏‏‏وَقَدْ رَوَى شُعْبَةُ هَذَا الْحَدِيثَ، ‏‏‏‏‏‏عَنْ أَيُّوبَ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنْ ابْنِ عَبَّاسٍ وَرَوَى عَبْدُ الْوَهَّابِ الثَّقَفِيُّ وَغَيْرُهُ، ‏‏‏‏‏‏عَنْ أَيُّوبَ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، وَنَافِعٍ، عَنْ ابْنِ عُمَرَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَهَذَا أَصَحُّ.

Urdu Translation

عبداللہ بن عمر رضی الله عنہما کہتے ہیں کہ   نبی اکرم صلی اللہ علیہ وسلم نے حمل کے حمل کو بیچنے سے منع فرمایا ۱؎۔ امام ترمذی کہتے: ۱- ابن عمر رضی الله عنہما کی حدیث حسن صحیح ہے، ۲- شعبہ نے اس حدیث کو بطریق: «عن أيوب عن سعيد بن جبير عن ابن عباس» روایت کیا ہے۔ اور عبدالوھاب ثقفی وغیرہ نے بطریق: «عن أيوب عن سعيد بن جبير ونافع عن ابن عمر عن النبي صلى الله عليه وسلم» روایت کی ہے۔ اور یہ زیادہ صحیح ہے، ۳- اہل علم کا اسی پر عمل ہے۔ «حبل الحبلة» ( حمل کے حمل ) سے مراد اونٹنی کے بچے کا بچہ ہے۔ اہل علم کے نزدیک یہ بیع منسوخ ہے اور یہ دھوکہ کی بیع میں سے ایک بیع ہے، ۴- اس باب میں عبداللہ بن عباس اور ابو سعید خدری رضی الله عنہم سے بھی احادیث آئی ہیں۔

English Translation

Narrated Ibn 'Umar: The Prophet (ﷺ) prohibited the sale of Habalil-Habalah. [He said:] There are narrations on this topic from 'Abdullah bin 'Abbas and Abu Sa'eed Al-Khudri [Abu 'Eisa said:] The Hadith of Ibn 'Umar is Hasan Sahih Hadith. This is acted upon according to the people of knowledge. And Hababil-Habalah is the offspring of the offspring (of an animal). It is an invalid sale according to the people of knowledge and it is type of Gharar sale. Shu'bah reported this Hadith from Ayyub, from Sa'eed bin Jubair, from Ibn 'Abbas. 'Abdul Wahhab Ath-Thaqafi and others reported it from Ayyub, from Sa'eed bin Jubair and Nafi', from Ibn 'Umar, from the Prophet (ﷺ), and this is more correct.
