Narrated Samurah: The Messenger of Allah (ﷺ) prohibited bartering animals on credit. He said: There are narration on this topic from Ibn 'Abbas, Jabir, Ibn 'Umar. [Abu 'Eisa said:] The Hadith of Samurah is Hasan Sahih Hadith. It is correct that Al-Hasan heard from Samurah, this is what 'Ali bin Al-Madini and others said. Regarding (the prohibition of) bartering animals on credit, this is acted upon according to most of the people of knowledge among the Companions of the Prophet (ﷺ) and others. This is the view of Sufyan Ath-Thawri and the people of Al-Kufah, and it is the view of Ahmad. Some of the people of knowledge, among the Companions of the Prophet (ﷺ) and others, permitted bartering animals for animals on credit. This is the view of Ash-Shafi'i and Ishaq.

حَدَّثَنَا أَبُو مُوسَى مُحَمَّدُ بْنُ مُثَنَّى، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ قَتَادَةَ، عَنْ الْحَسَنِ، عَنْ سَمُرَةَ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ نَهَى عَنْ بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً . قَالَ:‏‏‏‏ وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ ابْنِ عَبَّاسٍ، ‏‏‏‏‏‏وَجَابِرٍ، ‏‏‏‏‏‏وَابْنِ عُمَرَ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ سَمُرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَسَمَاعُ الْحَسَنِ مِنْ سَمُرَةَ صَحِيحٌ، ‏‏‏‏‏‏هَكَذَا قَالَ:‏‏‏‏ عَلِيُّ بْنُ الْمَدِينِيِّ وَغَيْرُهُ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، ‏‏‏‏‏‏فِي بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ سُفْيَانَ الثَّوْرِيِّ، ‏‏‏‏‏‏وَأَهْلِ الْكُوفَةِ، ‏‏‏‏‏‏وَبِهِ يَقُولُ أَحْمَدُ، ‏‏‏‏‏‏وَقَدْ رَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، ‏‏‏‏‏‏فِي بَيْعِ الْحَيَوَانِ بِالْحَيَوَانِ نَسِيئَةً، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ الشَّافِعِيِّ، ‏‏‏‏‏‏وَإِسْحَاق

سمرہ رضی الله عنہ کہتے ہیں کہ   نبی اکرم صلی اللہ علیہ وسلم نے جانور کو جانور سے ادھار بیچنے سے منع فرمایا ہے۔ امام ترمذی کہتے ہیں: ۱- سمرہ رضی الله عنہ کی حدیث حسن صحیح ہے، ۲- حسن کا سماع سمرہ سے صحیح ہے۔ علی بن مدینی وغیرہ نے ایسا ہی کہا ہے، ۳- اس باب میں ابن عباس، جابر اور ابن عمر رضی الله عنہم سے بھی احادیث آئی ہیں، ۴- صحابہ کرام وغیرہم میں سے اکثر اہل علم کا جانور کو جانور سے ادھار بیچنے کے مسئلہ میں اسی حدیث پر عمل ہے۔ سفیان ثوری اور اہل کوفہ کا یہی قول ہے۔ احمد بھی اسی کے قائل ہیں، ۵- صحابہ کرام وغیرہم میں سے بعض اہل علم نے جانور کے جانور سے ادھار بیچنے کی اجازت دی ہے۔ اور یہی شافعی، اور اسحاق بن راہویہ کا بھی قول ہے۔
