حَدَّثَنَا وَاصِلُ بْنُ عَبْدِ الْأَعْلَى، حَدَّثَنَا الْكوِفِيُّ بْنُ فُضَيْلٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ نَافِعٍ، عَنْ ابْنِ عُمَرَ، قَالَ:‏‏‏‏ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ:‏‏‏‏ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا أَوْ يَخْتَارَا ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ فَكَانَ ابْنُ عُمَرَ إِذَا ابْتَاعَ بَيْعًا وَهُوَ قَاعِدٌ، ‏‏‏‏‏‏قَامَ لِيَجِبَ لَهُ الْبَيْعُ. قَالَ أَبُو عِيسَى:‏‏‏‏ وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ أَبِي بَرْزَةَ، ‏‏‏‏‏‏وَحَكِيمِ بْنِ حِزَامٍ، ‏‏‏‏‏‏وَعَبْدِ اللَّهِ بْنِ عَبَّاسٍ، ‏‏‏‏‏‏وَعَبْدِ اللَّهِ بْنِ عَمْرٍو، ‏‏‏‏‏‏وَسَمُرَةَ، ‏‏‏‏‏‏وَأَبِي هُرَيْرَةَ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ ابْنِ عُمَرَ حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ الشَّافِعِيِّ، ‏‏‏‏‏‏وَأَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏وَقَالُوا:‏‏‏‏ الْفُرْقَةُ بِالْأَبْدَانِ لَا بِالْكَلَامِ، ‏‏‏‏‏‏وَقَدْ قَالَ بَعْضُ أَهْلِ الْعِلْمِ:‏‏‏‏ مَعْنَى قَوْلِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ مَا لَمْ يَتَفَرَّقَا يَعْنِي الْفُرْقَةَ بِالْكَلَامِ ، ‏‏‏‏‏‏وَالْقَوْلُ الْأَوَّلُ أَصَحُّ لِأَنَّ ابْنَ عُمَرَ هُوَ رَوَى عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏وَهُوَ أَعْلَمُ بِمَعْنَى مَا رَوَى. وَرُوِيَ عَنْهُ أَنَّهُ كَانَ إِذَا أَرَادَ أَنْ يُوجِبَ الْبَيْعَ مَشَى لِيَجِبَ لَهُ.

Urdu Translation

عبداللہ بن عمر رضی الله عنہما کہتے ہیں کہ   میں نے رسول اللہ صلی اللہ علیہ وسلم کو فرماتے سنا: ”بیچنے والا اور خریدنے والا دونوں کو جب تک وہ جدا نہ ہوں بیع کو باقی رکھنے اور فسخ کرنے کا اختیار ہے ۱؎ یا وہ دونوں اختیار کی شرط کر لیں“ ۲؎۔ نافع کہتے ہیں: جب ابن عمر رضی الله عنہما کوئی چیز خریدتے اور بیٹھے ہوتے تو کھڑے ہو جاتے تاکہ بیع واجب ( پکی ) ہو جائے ( اور اختیار باقی نہ رہے ) ۔ امام ترمذی کہتے ہیں: ۱- ابن عمر رضی الله عنہما کی حدیث حسن صحیح ہے، ۲- اس باب میں ابوبرزہ، حکیم بن حزام، عبداللہ بن عباس، عبداللہ بن عمرو، سمرہ اور ابوہریرہ رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- صحابہ کرام وغیرہم میں سے بعض اہل علم کا اسی پر عمل ہے۔ اور یہی شافعی، احمد اور اسحاق بن راہویہ کا بھی قول ہے۔ یہ لوگ کہتے ہیں کہ تفرق سے مراد جسمانی جدائی ہے نہ کہ قولی جدائی، یعنی مجلس سے جدائی مراد ہے گفتگو کا موضوع بدلنا مراد نہیں، ۴- اور بعض اہل علم کہتے ہیں کہ نبی اکرم صلی اللہ علیہ وسلم کے قول «مالم يتفرقا» سے مراد قولی جدائی ہے، پہلا قول زیادہ صحیح ہے، اس لیے کہ ابن عمر رضی الله عنہما نے ہی اس کو نبی اکرم صلی اللہ علیہ وسلم سے روایت کیا ہے۔ اور وہ اپنی روایت کردہ حدیث کا معنی زیادہ جانتے ہیں اور ان سے مروی ہے کہ جب وہ بیع واجب ( پکی ) کرنے کا ارادہ کرتے تو ( مجلس سے اٹھ کر ) چل دیتے تاکہ بیع واجب ہو جائے، ۵- ابوبرزہ رضی الله عنہ سے بھی اسی طرح مروی ہے۔

English Translation

Narrated Nafi': From Ibn 'Umar, that the Messenger of Allah (ﷺ) said: Both the buyer and the seller retain the option as long as they have not separated or they give each other than option. He (Nafi') said: So when Ibn 'Umar purchased something while he was sitting, he would stand to complete the sale.
