Narrated 'Amr bin Shu'aib: From his father, from his grandfather, that the Messenger of Allah (ﷺ) said: Both the buyer and the seller retain the option as long as they did not separate, unless they agreed to making it optional. And it is not lawful for him to separate from his companion, fearing that he will change his mind. [Abu 'Eisa said:] This Hadith is Hasan and this means separating from him after the sale, fearing that he will change his mind. And if the separation referred to speech, and there was no option left for him after the sale, then this Hadith would be meaningless, since he (ﷺ) said: And it is not lawful for him to separate from his companion, fearing that he will change his mind.

أَخْبَرَنَا بِذَلِكَ قُتَيْبَةُ بْنُ سَعِيدٍ، حَدَّثَنَا اللَّيْثُ بْنُ سَعْدٍ، عَنْ ابْنِ عَجْلَانَ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا إِلَّا أَنْ تَكُونَ صَفْقَةَ خِيَارٍ، ‏‏‏‏‏‏وَلَا يَحِلُّ لَهُ أَنْ يُفَارِقَ صَاحِبَهُ خَشْيَةَ أَنْ يَسْتَقِيلَهُ . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ، ‏‏‏‏‏‏وَمَعْنَى هَذَا أَنْ يُفَارِقَهُ بَعْدَ الْبَيْعِ خَشْيَةَ أَنْ يَسْتَقِيلَهُ، ‏‏‏‏‏‏وَلَوْ كَانَتِ الْفُرْقَةُ بِالْكَلَامِ، ‏‏‏‏‏‏وَلَمْ يَكُنْ لَهُ خِيَارٌ بَعْدَ الْبَيْعِ لَمْ يَكُنْ لِهَذَا الْحَدِيثِ مَعْنًى حَيْثُ قَالَ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ وَلَا يَحِلُّ لَهُ أَنْ يُفَارِقَهُ خَشْيَةَ أَنْ يَسْتَقِيلَهُ .

عبداللہ بن عمرو رضی الله عنہما کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”بائع اور مشتری جب تک جدا نہ ہوں ان کو اختیار ہے الا یہ کہ بیع خیار ہو ( تب جدا ہونے کے بعد بھی واپسی کا اختیار باقی رہتا ہے ) ، اور بائع کے لیے جائز نہیں ہے کہ اپنے ساتھی ( مشتری ) سے اس ڈر سے جدا ہو جائے کہ وہ بیع کو فسخ کر دے گا“۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن ہے، ۲- اور اس کا معنی یہی ہے کہ بیع کے بعد وہ مشتری سے جدا ہو جائے اس ڈر سے کہ وہ اسے فسخ کر دے گا اور اگر جدائی صرف کلام سے ہو جاتی، اور بیع کے بعد مشتری کو اختیار نہ ہوتا تو اس حدیث کا کوئی معنی نہ ہو گا جو کہ آپ نے فرمایا ہے: ”بائع کے لیے جائز نہیں ہے کہ وہ مشتری سے اس ڈر سے جدا ہو جائے کہ وہ اس کی بیع کو فسخ کر دے گا“۔
