حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنْ أَبِي شُجَاعٍ سَعِيدِ بْنِ يَزِيدَ، عَنْ خَالِدِ بْنِ أَبِي عِمْرَانَ، عَنْ حَنَشٍ الصَّنْعَانِيِّ، عَنْ فَضَالَةَ بْنِ عُبَيْدٍ، قَالَ:‏‏‏‏ اشْتَرَيْتُ يَوْمَ خَيْبَرَ قِلَادَةً بِاثْنَيْ عَشَرَ دِينَارًا فِيهَا ذَهَبٌ، ‏‏‏‏‏‏وَخَرَزٌ فَفَصَلْتُهَا، ‏‏‏‏‏‏فَوَجَدْتُ فِيهَا أَكْثَرَ مِنَ اثْنَيْ عَشَرَ دِينَارًا. فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ لَا تُبَاعُ حَتَّى تُفْصَلَ . حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا ابْنُ الْمُبَارَكِ، عَنْ أَبِي شُجَاعٍ سَعِيدِ بْنِ يَزِيدَ، بِهَذَا الْإِسْنَادِ نَحْوَهُ. قَالَ أَبُو عِيسَى 12:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، ‏‏‏‏‏‏لَمْ يَرَوْا أَنْ يُبَاعَ السَّيْفُ مُحَلًّى، ‏‏‏‏‏‏أَوْ مِنْطَقَةٌ مُفَضَّضَةٌ، ‏‏‏‏‏‏أَوْ مِثْلُ هَذَا بِدَرَاهِمَ حَتَّى يُمَيَّزَ وَيُفْصَلَ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ ابْنِ الْمُبَارَكِ، ‏‏‏‏‏‏وَالشَّافِعِيِّ، ‏‏‏‏‏‏وَأَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏وَقَدْ رَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ فِي ذَلِكَ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ.

Urdu Translation

فضالہ بن عبید رضی الله عنہ کہتے ہیں کہ   میں نے خیبر کے دن بارہ دینار میں ایک ہار خریدا، جس میں سونے اور جواہرات جڑے ہوئے تھے، میں نے انہیں ( توڑ کر ) جدا جدا کیا تو مجھے اس میں بارہ دینار سے زیادہ ملے۔ میں نے نبی اکرم صلی اللہ علیہ وسلم سے اس کا ذکر کیا تو آپ نے فرمایا: ” ( سونے اور جواہرات جڑے ہوئے ہار ) نہ بیچے جائیں جب تک انہیں جدا جدا نہ کر لیا جائے“۔ اسی طرح مؤلف نے قتیبہ سے اسی سند سے حدیث روایت کی ہے۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- صحابہ کرام وغیرہم میں سے بعض اہل علم کا اسی پر عمل ہے۔ یہ لوگ چاندی جڑی ہوئی تلوار یا کمر بند یا اسی جیسی دوسرے چیزوں کو درہم سے فروخت کرنا درست نہیں سمجھتے ہیں، جب تک کہ ان سے چاندی الگ نہ کر لی جائے۔ ابن مبارک، شافعی، احمد اور اسحاق بن راہویہ کا بھی یہی قول ہے۔ ۳- اور صحابہ کرام وغیرہم میں سے بعض اہل علم نے اس کی اجازت دی ہے۔

English Translation

Narrated Fadalah bin 'Ubaidah: On the Day of Khaibar I purchased a necklace that contained gold and jewels for twelve Dinar. I separated it and found that it was worth more than twelve Dinar. I mentioned that to the Prophet (ﷺ) and he said: 'Do not sell it until it is separated.'
