حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ،‏‏‏‏ حَدَّثَنَا هُشَيْمٌ،‏‏‏‏ عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ،‏‏‏‏ عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ،‏‏‏‏ قَالَ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ الْعُمْرَى جَائِزَةٌ لِأَهْلِهَا،‏‏‏‏ وَالرُّقْبَى جَائِزَةٌ لِأَهْلِهَا . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ،‏‏‏‏ وَقَدْ رَوَى بَعْضُهُمْ،‏‏‏‏ عَنْ أَبِي الزُّبَيْرِ،‏‏‏‏ بِهَذَا الْإِسْنَادِ عَنْ جَابِرٍ،‏‏‏‏ مَوْقُوفًا وَلَمْ يَرْفَعْهُ،‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ،‏‏‏‏ أَنَّ الرُّقْبَى جَائِزَةٌ مِثْلَ الْعُمْرَى،‏‏‏‏ وَهُوَ قَوْلُ:‏‏‏‏ أَحْمَدَ،‏‏‏‏ وَإِسْحَاق،‏‏‏‏ وَفَرَّقَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَهْلِ الْكُوفَةِ وَغَيْرِهِمْ،‏‏‏‏ بَيْنَ الْعُمْرَى،‏‏‏‏ وَالرُّقْبَى،‏‏‏‏ فَأَجَازُوا الْعُمْرَى،‏‏‏‏ وَلَمْ يُجِيزُوا الرُّقْبَى. قَالَ أَبُو عِيسَى:‏‏‏‏ وَتَفْسِيرُ الرُّقْبَى:‏‏‏‏ أَنْ يَقُولَ هَذَا الشَّيْءُ لَكَ مَا عِشْتَ،‏‏‏‏ فَإِنْ مُتَّ قَبْلِي فَهِيَ رَاجِعَةٌ إِلَيَّ،‏‏‏‏ وَقَالَ أَحْمَدُ،‏‏‏‏ وَإِسْحَاق،‏‏‏‏ الرُّقْبَى مِثْلُ الْعُمْرَى،‏‏‏‏ وَهِيَ لِمَنْ أُعْطِيَهَا،‏‏‏‏ وَلَا تَرْجِعُ إِلَى الْأَوَّلِ.

Urdu Translation

جابر رضی الله عنہ کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”عمریٰ جس کو دیا گیا اس کے گھر والوں کا ہے اور رقبیٰ ۱؎ بھی جس کو دیا گیا ہے اس کے گھر والوں کا ہے“۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن ہے، ۲- اور بعض نے اسی سند سے ابوزبیر سے روایت کی ہے کہ انہوں نے اسے جابر سے موقوفاً نقل کیا ہے، اسے نبی اکرم صلی اللہ علیہ وسلم تک مرفوع نہیں کیا ہے، ۳- رقبیٰ کی تفسیر یہ ہے کہ کوئی آدمی کہے کہ یہ چیز جب تک تم زندہ رہو گے تمہاری ہے اور اگر تم مجھ سے پہلے مر گئے تو یہ پھر میری طرف لوٹ آئے گی، ۴- صحابہ کرام وغیرہم میں سے بعض اہل علم کا اسی پر عمل ہے کہ عمریٰ کی طرح رقبیٰ بھی جسے دیا گیا ہے اس کے گھر والوں ہی کا ہو گا۔ احمد اور اسحاق بن راہویہ کا یہی قول ہے۔ اور اہل کوفہ وغیرہم میں سے بعض اہل علم نے عمریٰ اور رقبیٰ کے درمیان فرق کیا ہے، ان لوگوں نے عمریٰ کو تو معمر ( جس کے نام چیز دی گئی تھی ) کی موت کے بعد اس کے ورثاء کا حق بتایا ہے اور رقبیٰ کو کہا ہے کہ ورثاء کا حق نہیں ہو گا بلکہ وہ دینے والی کی طرف لوٹ جائے گا۔

English Translation

Jabir narrated that the Messenger of Allah (ﷺ) said: The lifelong gift is permitted for its inhabitant, and the Ruqba is permitted for its inhabitant.
