حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مُعَاوِيَةَ الْجُمَحِيُّ الْبَصْرِيُّ،‏‏‏‏ حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ،‏‏‏‏ عَنْ قَتَادَةَ،‏‏‏‏ عَنْ الْحَسَنِ،‏‏‏‏ عَنْ سَمُرَةَ،‏‏‏‏ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ لَا نَعْرِفُهُ مُسْنَدًا إِلَّا مِنْ حَدِيثِ حَمَّادِ بْنِ سَلَمَةَ،‏‏‏‏ وَقَدْ رَوَى بَعْضُهُمْ هَذَا الْحَدِيثَ عَنْ قَتَادَةَ،‏‏‏‏ عَنْ الْحَسَنِ،‏‏‏‏ عَنْ عُمَرَ شَيْئًا مِنْ هَذَا. (حديث مرفوع) حَدَّثَنَا عُقْبَةُ بْنُ مُكْرَمٍ الْعَمِّيُّ الْبَصْرِيُّ، وَغَيْرُ وَاحِدٍ،‏‏‏‏ قَالُوا:‏‏‏‏ حَدَّثَنَا مُحَمَّدُ بْنُ بَكْرٍ الْبُرْسَانِيُّ،‏‏‏‏ عَنْ حَمَّادِ بْنِ سَلَمَةَ،‏‏‏‏ عَنْ قَتَادَةَ،‏‏‏‏ وَعَاصِمٍ الْأَحْوَلِ،‏‏‏‏ عَنْ الْحَسَنِ،‏‏‏‏ عَنْ سَمُرَةَ،‏‏‏‏ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ . قَالَ أَبُو عِيسَى:‏‏‏‏ وَلَا نَعْلَمُ أَحَدًا ذَكَرَ فِي هَذَا الْحَدِيثِ عَاصِمًا الْأَحْوَلَ،‏‏‏‏ عَنْ حَمَّادِ بْنِ سَلَمَةَ،‏‏‏‏ غَيْرَ مُحَمَّدِ بْنِ بَكْرٍ،‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ،‏‏‏‏ وَقَدْ رُوِيَ عَنْ ابْنِ عُمَرَ،‏‏‏‏ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ . رَوَاهُ ضَمْرَةُ بْنُ رَبِيعَةَ، عَنْ الثَّوْرِيِّ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنْ ابْنِ عُمَرَ،‏‏‏‏ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَمْ يُتَابَعْ ضَمْرَةُ عَلَى هَذَا الْحَدِيثِ،‏‏‏‏ وَهُوَ حَدِيثٌ خَطَأٌ عِنْدَ أَهْلِ الْحَدِيثِ.

Urdu Translation

سمرہ رضی الله عنہ کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جو شخص کسی محرم رشتہ دار کا مالک ہو جائے تو وہ ( رشتہ دار ) آزاد ہو جائے گا“۔ امام ترمذی کہتے ہیں: ۱- اس حدیث کو ہم صرف حماد بن سلمہ ہی کی روایت سے مسنداً ( مرفوعاً ) جانتے ہیں، ۲- اور بعض لوگوں نے اس حدیث کے کچھ حصہ کو قتادہ سے اور قتادہ نے حسن سے اور حسن نے عمر رضی الله عنہ سے ( موقوفاً ) روایت کیا ہے۔ اس سند سے محمد بن بکر برسانی نے بیان کیا انہوں نے حماد بن سلمہ سے اور حماد نے قتادہ اور عاصم احول سے اور قتادہ اور عاصم نے حسن بصری سے اور حسن نے سمرہ سے اور سمرہ نے نبی اکرم صلی اللہ علیہ وسلم سے روایت کی ہے کہ آپ نے فرمایا: ”جو شخص کسی محرم قرابت دار کا مالک ہو جائے تو وہ آزاد ہو جائے گا“، امام ترمذی کہتے ہیں: ۳- محمد بن بکر کے علاوہ ہم کسی کو نہیں جانتے ہیں جس نے عاصم احول کا ذکر کیا ہو اور انہوں ( عاصم ) نے حماد بن سلمہ سے روایت کی ہو، ۴- بعض اہل علم کا اسی حدیث پر عمل ہے، ۵- ابن عمر رضی الله عنہما نے نبی اکرم صلی اللہ علیہ وسلم سے روایت کی ہے کہ آپ نے فرمایا: ”جو شخص کسی محرم قرابت دار کا مالک ہو جائے تو وہ آزاد ہو جائے گا“۔ اسے ضمرہ بن ربیعہ نے ثوری سے روایت کیا ہے، انہوں نے عبداللہ بن دینار سے، اور عبداللہ نے ابن عمر سے اور ابن عمر نے نبی اکرم صلی اللہ علیہ وسلم سے۔ اس حدیث کی روایت میں لوگوں نے ضمرہ کی متابعت نہیں کی ہے۔ محدثین کے نزدیک یہ حدیث غلط ہے ۱؎۔

English Translation

Samurah narrated that the Messenger of Allah (ﷺ) said: Whoever owns a related Mahram, then he is free.
