Baab Kahanat Aur Bud Faali Se Mutaliq Ehkaam O Masail

أَخْبَرَنَا إِسْحَاق بْنُ مَنْصُورٍ، أَخْبَرَنَا أَبُو عَاصِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنْ عَمْرِو بْنِ مُسْلِمٍ، عَنْ طَاوُسٍ، عَنْ عَائِشَةَ، قَالَتْ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ الْخَالُ وَارِثُ مَنْ لَا وَارِثَ لَهُ ، ‏‏‏‏‏‏وَهَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ، ‏‏‏‏‏‏وَقَدْ أَرْسَلَهُ بَعْضُهُمْ وَلَمْ يَذْكُرْ فِيهِ عَنْ عَائِشَةَ، ‏‏‏‏‏‏وَاخْتَلَفَ فِيهِ أَصْحَابُ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَوَرَّثَ بَعْضُهُمُ الْخَالَ وَالْخَالَةَ وَالْعَمَّةَ، ‏‏‏‏‏‏وَإِلَى هَذَا الْحَدِيثِ ذَهَبَ أَكْثَرُ أَهْلِ الْعِلْمِ فِي تَوْرِيثِ ذَوِي الْأَرْحَامِ، ‏‏‏‏‏‏وَأَمَّا زَيْدُ بْنُ ثَابِتٍ فَلَمْ يُوَرِّثْهُمْ، ‏‏‏‏‏‏وَجَعَلَ الْمِيرَاثَ فِي بَيْتِ الْمَالِ.

Urdu Translation

ام المؤمنین عائشہ رضی الله عنہا کہتی ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”ماموں اس آدمی کا وارث ہے جس کا کوئی وارث نہیں ہے“۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن غریب ہے، ۲- بعض لوگوں نے اسے مرسلاً روایت کیا ہے اور اس میں عائشہ رضی الله عنہا کے واسطہ کا ذکر نہیں کیا، ۳- اس مسئلہ میں صحابہ کرام کا اختلاف ہے، بعض لوگوں نے ماموں، خالہ اور پھوپھی کو وارث ٹھہرایا ہے۔ ذوی الارحام ( قرابت داروں ) کو وارث بنانے کے بارے میں اکثر اہل علم اسی حدیث کی طرف گئے ہیں، ۴- لیکن زید بن ثابت رضی الله عنہ نے بھی انہیں وارث نہیں ٹھہرایا ہے یہ میراث کو بیت المال میں رکھنے کے قائل ہیں۔

English Translation

Aishah narrated that the Messenger of Allah(S.A.W) said: The maternal uncle inherits from the one who has no heirs.
