حَدَّثَنَا مَحْمُودُ بْنُ غَيْلَانَ، حَدَّثَنَا أَبُو دَاوُدَ الطَّيَالِسِيُّ، أَخْبَرَنَا شُعْبَةُ، أَخْبَرَنِي خُبَيْبُ بْنُ عَبْدِ الرَّحْمَنِ، قَال:‏‏‏‏ سَمِعْتُ عَبْدَ الرَّحْمَنِ بْنَ مَسْعُودِ بْنِ نِيَارٍ، يَقُولُ:‏‏‏‏ جَاءَ سَهْلُ بْنُ أَبِي حَثْمَةَ إِلَى مَجْلِسِنَا، ‏‏‏‏‏‏فَحَدَّثَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يَقُولُ:‏‏‏‏ إِذَا خَرَصْتُمْ فَخُذُوا وَدَعُوا الثُّلُثَ فَإِنْ لَمْ تَدَعُوا الثُّلُثَ فَدَعُوا الرُّبُعَ . قَالَ:‏‏‏‏ وَفِي الْبَاب عَنْ عَائِشَةَ، ‏‏‏‏‏‏وَعَتَّابِ بْنِ أَسِيدٍ، ‏‏‏‏‏‏وَابْنِ عَبَّاسٍ. قَالَ أَبُو عِيسَى:‏‏‏‏ وَالْعَمَلُ عَلَى حَدِيثِ سَهْلِ بْنِ أَبِي حَثْمَةَ عِنْدَ أَكْثَرِ أَهْلِ الْعِلْمِ فِي الْخَرْصِ، ‏‏‏‏‏‏وَبِحَدِيثِ سَهْلِ بْنِ أَبِي حَثْمَةَ، ‏‏‏‏‏‏يَقُولُ أَحْمَدُ، ‏‏‏‏‏‏وَإِسْحَاق:‏‏‏‏ وَالْخَرْصُ:‏‏‏‏ إِذَا أَدْرَكَتِ الثِّمَارُ مِنَ الرُّطَبِ وَالْعِنَبِ مِمَّا فِيهِ الزَّكَاةُ بَعَثَ السُّلْطَانُ خَارِصًا يَخْرُصُ عَلَيْهِمْ، ‏‏‏‏‏‏وَالْخَرْصُ أَنْ يَنْظُرَ مَنْ يُبْصِرُ ذَلِكَ، ‏‏‏‏‏‏فَيَقُولُ:‏‏‏‏ يَخْرُجُ مِنْ هَذَا الزَّبِيبِ كَذَا وَكَذَا وَمِنَ التَّمْرِ كَذَا وَكَذَا فَيُحْصِي عَلَيْهِمْ وَيَنْظُرُ مَبْلَغَ الْعُشْرِ مِنْ ذَلِكَ فَيُثْبِتُ عَلَيْهِمْ، ‏‏‏‏‏‏ثُمَّ يُخَلِّي بَيْنَهُمْ وَبَيْنَ الثِّمَارِ فَيَصْنَعُونَ مَا أَحَبُّوا، ‏‏‏‏‏‏فَإِذَا أَدْرَكَتِ الثِّمَارُ أُخِذَ مِنْهُمُ الْعُشْرُ. هَكَذَا فَسَّرَهُ بَعْضُ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏وَبِهَذَا يَقُولُ مَالِكٌ، ‏‏‏‏‏‏وَالشَّافِعِيُّ، ‏‏‏‏‏‏وَأَحْمَدُ، ‏‏‏‏‏‏وَإِسْحَاق.

Urdu Translation

عبدالرحمٰن بن مسعود بن نیار کہتے ہیں کہ   سہل بن ابی حثمہ رضی الله عنہ ہماری مجلس میں آئے تو بیان کیا کہ رسول اللہ صلی اللہ علیہ وسلم فرماتے تھے: ”جب تم تخمینہ لگاؤ تو تخمینہ کے مطابق لو اور ایک تہائی چھوڑ دیا کرو، اگر ایک تہائی نہ چھوڑ سکو تو چوتھائی چھوڑ دیا کرو“ ۱؎۔ امام ترمذی کہتے ہیں: ۱- اس باب میں عائشہ، عتاب بن اسید اور ابن عباس رضی الله عنہم سے بھی احادیث آئی ہیں۔ ۲- تخمینہ لگانے کے سلسلے میں اکثر اہل علم کا عمل سہل بن ابی حثمہ رضی الله عنہ کی حدیث پر ہے اور سہل بن ابی حثمہ رضی الله عنہ کی حدیث ہی کے مطابق احمد اور شافعی بھی کہتے ہیں، تخمینہ لگانا یہ ہے کہ جب کھجور یا انگور کے پھل جن کی زکاۃ دی جاتی ہے پک جائیں تو سلطان ( انتظامیہ ) ایک تخمینہ لگانے والے کو بھیجے جو اندازہ لگا کر بتائے کہ اس میں کتنا غلہ یا پھل ہو گا اور تخمینہ لگانا یہ ہے کہ کوئی تجربہ کار آدمی دیکھ کر یہ بتائے کہ اس درخت سے اتنا اتنا انگور نکلے گا، اور اس سے اتنی اتنی کھجور نکلے گی۔ پھر وہ اسے جوڑ کر دیکھے کہ کتنا عشر کی مقدار کو پہنچا، تو ان پر وہی عشر مقرر کر دے۔ اور پھل کے پکنے تک ان کو مہلت دے، پھل توڑنے کے وقت اپنا عشر دیتے رہیں۔ پھر مالکوں کو اختیار ہو گا کہ بقیہ سے جو چاہیں کریں۔ بعض اہل علم نے تخمینہ لگانے کی تشریح اسی طرح کی ہے، اور یہی مالک شافعی احمد اور اسحاق بن راہویہ بھی کہتے ہیں۔

English Translation

Abdur-Rahman bin Mas'ud bin Niyar said: Sahl bin Abi Hathmah came to a gathering of ours, and he narrated that the Messenger of Allah would say: When you make an assessment, then take it and leave a third, if you do not leave a third, then leave a quarter.
