حَدَّثَنَا هَنَّادٌ، وَقُتَيْبَةُ، قَالَا:‏‏‏‏ حَدَّثَنَا أَبُو الْأَحْوَصِ، عَنْ زِيَادِ بْنِ عِلَاقَةَ، عَنْ عَمْرِو بْنِ مَيْمُونٍ، عَنْ عَائِشَةَ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يُقَبِّلُ فِي شَهْرِ الصَّوْمِ . قَالَ:‏‏‏‏ وَفِي الْبَاب عَنْ عُمَرَ بْنِ الْخَطَّابِ، ‏‏‏‏‏‏وَحَفْصَةَ، ‏‏‏‏‏‏وَأَبِي سَعِيدٍ، ‏‏‏‏‏‏وَأُمِّ سَلَمَةَ، ‏‏‏‏‏‏وَابْنِ عَبَّاسٍ، ‏‏‏‏‏‏وَأَنَسٍ، ‏‏‏‏‏‏وَأَبِي هُرَيْرَةَ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ عَائِشَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَاخْتَلَفَ أَهْلُ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ فِي الْقُبْلَةِ لِلصَّائِمِ، ‏‏‏‏‏‏فَرَخَّصَ بَعْضُ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي الْقُبْلَةِ لِلشَّيْخِ، ‏‏‏‏‏‏وَلَمْ يُرَخِّصُوا لِلشَّابِّ مَخَافَةَ أَنْ لَا يَسْلَمَ لَهُ صَوْمُهُ وَالْمُبَاشَرَةُ عِنْدَهُمْ أَشَدُّ، ‏‏‏‏‏‏وَقَدْ قَالَ بَعْضُ أَهْلِ الْعِلْمِ:‏‏‏‏ الْقُبْلَةُ تُنْقِصُ الْأَجْرَ، ‏‏‏‏‏‏وَلَا تُفْطِرُ الصَّائِمَ، ‏‏‏‏‏‏وَرَأَوْا أَنَّ لِلصَّائِمِ إِذَا مَلَكَ نَفْسَهُ أَنْ يُقَبِّلَ، ‏‏‏‏‏‏وَإِذَا لَمْ يَأْمَنْ عَلَى نَفْسِهِ تَرَكَ الْقُبْلَةَ لِيَسْلَمَ لَهُ صَوْمُهُ، ‏‏‏‏‏‏وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ، ‏‏‏‏‏‏وَالشَّافِعِيِّ

Urdu Translation

ام المؤمنین عائشہ رضی الله عنہا کہتی ہیں کہ   کہ نبی اکرم صلی اللہ علیہ وسلم ماہ صیام ( رمضان ) میں بوسہ لیتے تھے ۱؎۔ امام ترمذی کہتے ہیں: ۱- عائشہ رضی الله عنہا کی حدیث حسن صحیح ہے، ۲- اس باب میں عمر بن خطاب، حفصہ، ابو سعید خدری، ام سلمہ، ابن عباس، انس اور ابوہریرہ رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- صائم کے بوسہ لینے کے سلسلے میں صحابہ کرام وغیرہم کا اختلاف ہے۔ بعض صحابہ نے بوڑھے کے لیے بوسہ لینے کی رخصت دی ہے۔ اور نوجوانوں کے لیے اس اندیشے کے پیش نظر رخصت نہیں دی کہ اس کا صوم محفوظ و مامون نہیں رہ سکے گا۔ جماع ان کے نزدیک زیادہ سخت چیز ہے۔ بعض اہل علم نے کہا ہے: بوسہ اجر کم کر دیتا ہے لیکن اس سے روزہ دار کا روزہ نہیں ٹوٹتا، ان کا خیال ہے کہ روزہ دار کو اگر اپنے نفس پر قابو ( کنٹرول ) ہو تو وہ بوسہ لے سکتا ہے اور جب وہ اپنے آپ پر کنٹرول نہ رکھ سکے تو بوسہ نہ لے تاکہ اس کا روزہ محفوظ و مامون رہے۔ یہ سفیان ثوری اور شافعی کا قول ہے۔
