Baab Kheeti Bari Aur Bitai Ka Bayan

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ ، حَدَّثَنَا سُفْيَانُ ، قَالَ عَمْرٌو : قُلْتُ لِطَاوُسٍ : لَوْ تَرَكْتَ الْمُخَابَرَةَ فَإِنَّهُمْ يَزْعُمُونَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْهُ ، قَالَ : أَيْ عَمْرُو ، إِنِّي أُعْطِيهِمْ وَأُغْنِيهِمْ وَإِنَّ أَعْلَمَهُمْ . أَخْبَرَنِي يَعْنِي ابْنَ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَمْ يَنْهَ عَنْهُ ، وَلَكِنْ قَالَ : أَنْ يَمْنَحَ أَحَدُكُمْ أَخَاهُ خَيْرٌ لَهُ مِنْ أَنْ يَأْخُذَ عَلَيْهِ خَرْجًا مَعْلُومًا .

Urdu Translation

ہم سے علی بن عبداللہ نے بیان کیا، کہا ہم سے سفیان بن عیینہ نے بیان کیا، کہ عمرو بن دینار نے کہا کہ   میں نے طاؤس سے عرض کیا، کاش! آپ بٹائی کا معاملہ چھوڑ دیتے، کیونکہ ان لوگوں ( رافع بن خدیج اور جابر بن عبداللہ رضی اللہ عنہم وغیرہ ) کا کہنا ہے کہ نبی کریم صلی اللہ علیہ وسلم نے اس سے منع فرمایا ہے۔ اس پر طاؤس نے کہا کہ میں تو لوگوں کو زمین دیتا ہوں اور ان کا فائدہ کرتا ہوں۔ اور صحابہ میں جو بڑے عالم تھے انہوں نے مجھے خبر دی ہے۔ آپ کی مراد ابن عباس رضی اللہ عنہما سے تھی کہ نبی کریم صلی اللہ علیہ وسلم نے اس سے نہیں روکا۔ بلکہ آپ نے صرف یہ فرمایا تھا کہ اگر کوئی شخص اپنے بھائی کو ( اپنی زمین ) مفت دیدے تو یہ اس سے بہتر ہے کہ اس کا محصول لے۔

English Translation

Narrated `Amr: I said to Tawus, I wish you would give up Mukhabara (Sharecropping), for the people say that the Prophet forbade it. On that Tawus replied, O `Amr! I give the land to sharecroppers and help them. No doubt; the most learned man, namely Ibn `Abbas told me that the Prophet had not forbidden it but said, 'It is more beneficial for one to give his land free to one's brother than to charge him a fixed rental.
