حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ ، حَدَّثَنَا اللَّيْثُ ، عَنْ عُقَيْلٍ ، عَنِ ابْنِ شِهَابٍ ، قَالَ : أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ ، أَنَّهُ سَمِعَ مَرْوَانَ ، وَالْمِسْوَرَ بْنَ مَخْرَمَةَ رَضِيَ اللَّهُ عَنْهُمَا ، يُخْبِرَانِ عَنْ أَصْحَابِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : لَمَّا كَاتَبَ سُهَيْلُ بْنُ عَمْرٍو يَوْمَئِذٍ كَانَ فِيمَا اشْتَرَطَ سُهَيْلُ بْنُ عَمْرٍو عَلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ لَا يَأْتِيكَ مِنَّا أَحَدٌ ، وَإِنْ كَانَ عَلَى دِينِكَ إِلَّا رَدَدْتَهُ إِلَيْنَا ، وَخَلَّيْتَ بَيْنَنَا وَبَيْنَهُ ، فَكَرِهَ الْمُؤْمِنُونَ ذَلِكَ وَامْتَعَضُوا مِنْهُ ، وَأَبَى سُهَيْلٌ إِلَّا ذَلِكَ ، فَكَاتَبَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى ذَلِكَ ، فَرَدَّ يَوْمَئِذٍ أَبَا جَنْدَلٍ إِلَى أَبِيهِ سُهَيْلِ بْنِ عَمْرٍو ، وَلَمْ يَأْتِهِ أَحَدٌ مِنَ الرِّجَالِ إِلَّا رَدَّهُ فِي تِلْكَ الْمُدَّةِ وَإِنْ كَانَ مُسْلِمًا ، وَجَاءَ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ ، وَكَانَتْ أُمُّ كُلْثُومٍ بِنْتُ عُقْبَةَ بْنِ أَبِي مُعَيْطٍ مِمَّنْ خَرَجَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَوْمَئِذٍ وَهِيَ عَاتِقٌ ، فَجَاءَ أَهْلُهَا يَسْأَلُونَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ يَرْجِعَهَا إِلَيْهِمْ ، فَلَمْ يَرْجِعْهَا إِلَيْهِمْ لِمَا أَنْزَلَ اللَّهُ فِيهِنَّ إِذَا جَاءَكُمُ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ فَامْتَحِنُوهُنَّ اللَّهُ أَعْلَمُ بِإِيمَانِهِنَّ إِلَى قَوْلِهِ وَلا هُمْ يَحِلُّونَ لَهُنَّ سورة الممتحنة آية 10 .

Urdu Translation

ہم سے یحییٰ بن بکیر نے بیان کیا، کہا ہم سے لیث نے بیان کیا، ان سے عقیل نے، ان سے ابن شہاب نے بیان کیا، انہیں عروہ بن زبیر نے خبر دی، انہوں نے خلیفہ مروان اور مسور بن مخرمہ رضی اللہ عنہ سے سنا، یہ دونوں حضرات اصحاب رسول اللہ صلی اللہ علیہ وسلم سے خبر دیتے تھے کہ   جب سہیل بن عمرو نے ( حدیبیہ میں کفار قریش کی طرف سے معاہدہ صلح ) لکھوایا تو جو شرائط نبی کریم صلی اللہ علیہ وسلم کے سامنے سہیل نے رکھی تھیں، ان میں یہ شرط بھی تھیں کہ ہم میں سے کوئی بھی شخص اگر آپ کے یہاں ( فرار ہو کر ) چلا جائے خواہ وہ آپ کے دین پر ہی کیوں نہ ہو تو آپ کو اسے ہمارے حوالہ کرنا ہو گا۔ مسلمان یہ شرط پسند نہیں کر رہے تھے اور اس پر انہیں دکھ ہوا تھا۔ لیکن سہیل نے اس شرط کے بغیر صلح قبول نہ کی۔ آخر آپ صلی اللہ علیہ وسلم نے اسی شرط پر صلح نامہ لکھوا لیا۔ اتفاق سے اسی دن ابوجندل رضی اللہ عنہ کو جو مسلمان ہو کر آیا تھا ( معاہدہ کے تحت بادل ناخواستہ ) ان کے والد سہیل بن عمرو کے حوالے کر دیا گیا۔ اسی طرح مدت صلح میں جو مرد بھی آپ صلی اللہ علیہ وسلم کی خدمت میں ( مکہ سے بھاگ کر آیا ) آپ صلی اللہ علیہ وسلم نے اسے ان کے حوالے کر دیا۔ خواہ وہ مسلمان ہی کیوں نہ رہا ہو۔ لیکن چند ایمان والی عورتیں بھی ہجرت کر کے آ گئی تھیں، ام کلثوم بنت عقبہ بن ابی معیط رضی اللہ عنہا بھی ان میں شامل تھیں جو اسی دن ( مکہ سے نکل کر ) آپ صلی اللہ علیہ وسلم کی خدمت میں آئی تھیں، وہ جوان تھیں اور جب ان کے گھر والے آئے اور رسول اللہ صلی اللہ علیہ وسلم سے ان کی واپسی کا مطالبہ کیا، تو آپ صلی اللہ علیہ وسلم نے انہیں ان کے حوالے نہیں فرمایا، بلکہ عورتوں کے متعلق اللہ تعالیٰ ( سورۃ الممتحنہ میں ) ارشاد فرما چکا تھا «{‏ إذا جاءكم المؤمنات مهاجرات فامتحنوهن الله أعلم بإيمانهن‏ }‏ إلى قوله ‏ {‏ ولا هم يحلون لهن‏ }‏‏.‏» ‏‏‏‏ ”جب مسلمان عورتیں تمہارے یہاں ہجرت کر کے پہنچیں تو پہلے تم ان کا امتحان لے لو، یوں تو ان کے ایمان کے متعلق جاننے والا اللہ تعالیٰ ہی ہے۔ اللہ تعالیٰ کے اس ارشاد تک کہ ”کفار و مشرکین ان کے لیے حلال نہیں ہیں الخ۔“

English Translation

Narrated Marwan and al-Miswar bin Makhrama: (from the companions of Allah's Apostle) When Suhail bin `Amr agreed to the Treaty (of Hudaibiya), one of the things he stipulated then, was that the Prophet should return to them (i.e. the pagans) anyone coming to him from their side, even if he was a Muslim; and would not interfere between them and that person. The Muslims did not like this condition and got disgusted with it. Suhail did not agree except with that condition. So, the Prophet agreed to that condition and returned Abu Jandal to his father Suhail bin `Amr. Thenceforward the Prophet returned everyone in that period (of truce) even if he was a Muslim. During that period some believing women emigrants including Um Kulthum bint `Uqba bin Abu Muait who came to Allah's Apostle and she was a young lady then. Her relative came to the Prophet and asked him to return her, but the Prophet did not return her to them for Allah had revealed the following Verse regarding women: O you who believe! When the believing women come to you as emigrants. Examine them, Allah knows best as to their belief, then if you know them for true believers, Send them not back to the unbelievers, (for) they are not lawful (wives) for the disbelievers, Nor are the unbelievers lawful (husbands) for them (60.10)
