Baab Un Kuffar O Murtadon Ke Ehkaam Main Ju Musalmano Se Lerte Hain

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ ، حَدَّثَنَا اللَّيْثُ ، عَنْ سَعِيدٍ الْمَقْبُرِيِّ ، عَنْ أَبِيهِ ، عَنْ أَبِي هُرَيْرَةَ ، أَنَّهُ سَمِعَهُ ، يَقُولُ : قَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : إِذَا زَنَتِ الْأَمَةُ فَتَبَيَّنَ زِنَاهَا ، فَلْيَجْلِدْهَا وَلَا يُثَرِّبْ ، ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا وَلَا يُثَرِّبْ ، ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ ، فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعَرٍ ، تَابَعَهُ إِسْمَاعِيلُ بْنُ أُمَيَّةَ ، عَنْ سَعِيدٍ ، عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ .

Urdu Translation

ہم سے عبداللہ بن یوسف نے بیان کیا، کہا ہم سے لیث بن سعد نے بیان کیا، ان سے سعید مقبری نے، ان سے ان کے والد نے اور ان سے ابوہریرہ رضی اللہ عنہ نے، انہوں نے ابوہریرہ رضی اللہ عنہ کو یہ کہتے ہوئے سنا کہ   نبی کریم صلی اللہ علیہ وسلم نے فرمایا کہ اگر کنیز زنا کرائے اور اس کا زنا کھل جائے تو اسے کوڑے مارنے چاہئیں لیکن لعنت ملامت نہ کرنی چاہئے پھر اگر وہ دوبارہ زنا کرے تو پھر چاہئے کہ کوڑے مارے لیکن ملامت نہ کرے پھر اگر تیسری مرتبہ زنا کرائے تو بیچ دے خواہ بالوں کی ایک رسی ہی قیمت پر ہو۔ اس روایت کی متابعت اسماعیل بن امیہ نے سعید سے کی، ان سے ابوہریرہ رضی اللہ عنہ نے اور ان سے نبی کریم صلی اللہ علیہ وسلم نے۔

English Translation

Narrated Abu Huraira: The Prophet said, If a lady slave commits illegal sexual intercourse and she is proved guilty of illegal sexual intercourse, then she should be flogged (fifty stripes) but she should not be admonished; and if she commits illegal sexual intercourse again, then she should be flogged again but should not be admonished; and if she commits illegal sexual intercourse for the third time, then she should be sold even for a hair rope.
