حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ ، حَدَّثَنَا لَيْثٌ ، عَنِ ابْنِ شِهَابٍ ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ ، عَنِ ابْنِ عَبَّاسٍ ، أَنَّهُ قَالَ : اسْتَفْتَى سَعْدُ بْنُ عُبَادَةَ الْأَنْصَارِيُّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي نَذْرٍ كَانَ عَلَى أُمِّهِ ، تُوُفِّيَتْ قَبْلَ أَنْ تَقْضِيَهُ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : اقْضِهِ عَنْهَا ، وَقَالَ بَعْضُ النَّاسِ : إِذَا بَلَغَتِ الْإِبِلُ عِشْرِينَ فَفِيهَا أَرْبَعُ شِيَاهٍ ، فَإِنْ وَهَبَهَا قَبْلَ الْحَوْلِ ، أَوْ بَاعَهَا فِرَارًا وَاحْتِيَالًا لِإِسْقَاطِ الزَّكَاةِ ، فَلَا شَيْءَ عَلَيْهِ ، وَكَذَلِكَ إِنْ أَتْلَفَهَا فَمَاتَ ، فَلَا شَيْءَ فِي مَالِهِ .

Urdu Translation

ہم سے قتیبہ بن سعید نے بیان کیا، کہا ہم سے لیث بن سعد نے بیان کیا، ان سے ابن شہاب نے، ان سے عبیداللہ بن عتبہ نے، اور ان سے ابن عباس رضی اللہ عنہما نے بیان کیا کہ   سعد بن عبادہ انصاری رضی اللہ عنہ نے رسول اللہ صلی اللہ علیہ وسلم سے ایک نذر کے بارے میں سوال کیا جو ان کی والدہ پر تھی اور ان کی وفات نذر پوری کرنے سے پہلے ہی ہو گئی تھی۔ نبی کریم صلی اللہ علیہ وسلم نے فرمایا کہ تو ان کی طرف سے پوری کر۔ اس کے باوجود بعض لوگ یہ کہتے ہیں کہ جب اونٹ کی تعداد بیس ہو جائے تو اس میں چار بکریاں لازم ہیں۔ پس اگر سال پورا ہونے سے پہلے اونٹ کو ہبہ کر دے یا اسے بیچ دے۔ زکوٰۃ سے بچنے یا حیلہ کے طور پر تاکہ زکوٰۃ اس پر ختم ہو جائے تو اس پر کوئی چیز واجب نہیں ہو گی۔ یہی حال اس صورت میں ہے اگر اس نے ضائع کر دیا اور پھر مر گیا تو اس کے مال پر کچھ واجب نہیں ہو گا۔

English Translation

Narrated Ibn Abbas: Sa'd bin 'Ubada Al-Ansari sought the verdict of Allah's Apostle regarding a vow made by his mother who had died before fulfilling it. Allah's Apostle said, Fulfill it on her behalf. Some people said, If the number of camels reaches twenty, then their owner has to pay four sheep as Zakat; and if their owner gives them as a gift or sells them in order to escape the payment of Zakat cunningly before the completion of a year, then he is not to pay anything, and if he slaughters them and then dies, then no Zakat is to be taken from his property.
