Sunan Abu Dawood 2253 - Divorce (Kitab Al-Talaq)

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، ‏‏‏‏‏‏حَدَّثَنَا جَرِيرٌ، ‏‏‏‏‏‏عَنْ الْأَعْمَشِ، ‏‏‏‏‏‏عَنْ إِبْرَاهِيمَ، ‏‏‏‏‏‏عَنْ عَلْقَمَةَ، ‏‏‏‏‏‏عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ إِنَّا لَلَيْلَةُ جُمْعَةٍ فِي الْمَسْجِدِ، ‏‏‏‏‏‏إِذْ دَخَلَ رَجُلٌ مِنْ الْأَنْصَارِ فِي الْمَسْجِدِ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ لَوْ أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَتَكَلَّمَ بِهِ، ‏‏‏‏‏‏جَلَدْتُمُوهُ ؟ أَوْ قَتَلَ، ‏‏‏‏‏‏قَتَلْتُمُوهُ ؟ فَإِنْ سَكَتَ سَكَتَ عَلَى غَيْظٍ، ‏‏‏‏‏‏وَاللَّهِ لَأَسْأَلَنَّ عَنْهُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَلَمَّا كَانَ مِنَ الْغَدِ، ‏‏‏‏‏‏أَتَى رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَسَأَلَهُ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ لَوْ أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَتَكَلَّمَ بِهِ، ‏‏‏‏‏‏جَلَدْتُمُوهُ ؟ أَوْ قَتَلَ، ‏‏‏‏‏‏قَتَلْتُمُوهُ ؟ أَوْ سَكَتَ سَكَتَ عَلَى غَيْظٍ ؟ فَقَالَ:‏‏‏‏ اللَّهُمَّ افْتَحْ ، ‏‏‏‏‏‏وَجَعَلَ يَدْعُو فَنَزَلَتْ آيَةُ اللِّعَانِ:‏‏‏‏ وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَهُمْ شُهَدَاءُ إِلا أَنْفُسُهُمْ سورة النور آية 6 هَذِهِ الْآيَةَ، ‏‏‏‏‏‏فَابْتُلِيَ بِهِ ذَلِكَ الرَّجُلُ مِنْ بَيْنِ النَّاسِ، ‏‏‏‏‏‏فَجَاءَ هُوَ وَامْرَأَتُهُ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَتَلَاعَنَا، ‏‏‏‏‏‏فَشَهِدَ الرَّجُلُ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنَ الصَّادِقِينَ، ‏‏‏‏‏‏ثُمَّ لَعَنَ الْخَامِسَةَ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ فَذَهَبَتْ لِتَلْتَعِنَ، ‏‏‏‏‏‏فَقَالَ لَهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ مَهْ ، ‏‏‏‏‏‏فَأَبَتْ، ‏‏‏‏‏‏فَفَعَلَتْ، ‏‏‏‏‏‏فَلَمَّا أَدْبَرَا، ‏‏‏‏‏‏قَالَ:‏‏‏‏ لَعَلَّهَا أَنْ تَجِيءَ بِهِ أَسْوَدَ جَعْدًا ، ‏‏‏‏‏‏فَجَاءَتْ بِهِ أَسْوَدَ جَعْدًا.

Urdu Translation

عبداللہ بن مسعود رضی اللہ عنہ کہتے ہیں کہ   میں ( ایک دفعہ ) جمعہ کی رات مسجد میں تھا کہ اچانک انصار کا ایک شخص مسجد میں آیا، اور کہنے لگا: اگر کوئی شخص اپنی بیوی کے ساتھ کسی ( اجنبی ) آدمی کو پا لے اور ( حقیقت حال ) بیان کرے تو تم لوگ اسے کوڑے لگاؤ گے، یا وہ قتل کر دے تو اس کے بدلے میں تم لوگ اسے قتل کر دو گے، اور اگر وہ چپ رہے تو اندر ہی اندر غصہ میں جلے بھنے، اللہ کی قسم، میں اس سلسلہ میں رسول اللہ صلی اللہ علیہ وسلم سے ضرور دریافت کروں گا، چنانچہ جب دوسرا دن ہوا تو وہ رسول اللہ صلی اللہ علیہ وسلم کے پاس آیا اور اس نے عرض کیا کہ اگر کوئی شخص اپنی بیوی کے ساتھ کسی ( اجنبی ) آدمی کو پا لے اور حقیقت حال بیان کرے تو ( تہمت کی حد کے طور پر ) آپ اسے کوڑے لگائیں گے، یا وہ قتل کر دے تو اسے قتل کر دیں گے، یا وہ خاموشی اختیار کر کے اندر ہی غصہ سے جلے بھنے، یہ سن کر آپ صلی اللہ علیہ وسلم دعا کرنے لگے: اے اللہ! معاملے کی وضاحت فرما دے ، چنانچہ لعان کی آیت «والذين يرمون أزواجهم ولم يكن لهم شهداء إلا أنفسهم» اور جو لوگ اپنی بیویوں کو تہمت لگاتے ہیں اور ان کے پاس گواہ نہ ہوں ( سورۃ النور: ۶ ) آخر تک نازل ہوئی تو لوگوں میں یہی شخص اس مصیبت میں مبتلا ہوا چنانچہ وہ دونوں میاں بیوی رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئے اور ان دونوں نے لعان کیا، اس آدمی نے چار بار اللہ کا نام لے کر اپنے سچے ہونے کی گواہی دی، اور پانچویں بار کہا کہ اگر وہ جھوٹا ہو تو اس پر اللہ کی لعنت ہو، پھر عورت لعان کرنے چلی تو آپ صلی اللہ علیہ وسلم نے فرمایا: ٹھہرو ، لیکن وہ نہیں مانی اور لعان کر ہی لیا، تو جب وہ دونوں جانے لگے، تو آپ صلی اللہ علیہ وسلم نے فرمایا: شاید یہ عورت کالا گھنگرالے بالوں والا بچہ جنم دے چنانچہ اس نے وہ کالا اور گھنگرالے بالوں والا بچہ ہی جنم دیا۔

English Translation

Abdullah (bin Masud) said “We were in the mosque on the night of a Friday, suddenly a man from the Ansar entered the mosque”. And said “If a man finds a man along with wife and declares (about her adultery) you will flog him. Or if he kills you, you will kill him or if keeps silence he will keep silence in anger. I swear by Allaah, I shall ask the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم about it”. On the next day he came to the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم and said “If a man finds a man along with wife and declares (about her adultery) you will flog him. Or if he kills you, you will kill him or if keeps silence he will keep silence in anger. ” He said “O Allaah, disclose”. He kept on praying until the verses regarding invoking curses (li’an) came down “As for those who accuse their wives but have no witnesses except themselves. ” So, the man was first involved in this trial among the people. He and his wife came to the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم. They invoked curses on each other. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. She then wanted to invoke curses of Allaah on him. The Prophet صلی ‌اللہ ‌علیہ ‌وسلم said “Do not do that. Bust she refused and did so (i. e., invoked curses). When they returned he said “Perhaps she will give birth to a black child with curly hair.
