Sunan Abu Dawood 2280 - Divorce (Kitab Al-Talaq)

حَدَّثَنَا عَبَّادُ بْنُ مُوسَى، ‏‏‏‏‏‏أَنَّ إِسْمَاعِيلَ بْنَ جَعْفَرٍ حَدَّثَهُمْ، ‏‏‏‏‏‏عَنْ إِسْرَائِيلَ، ‏‏‏‏‏‏عَنْ أَبِي إِسْحَاقَ، ‏‏‏‏‏‏عَنْ هَانِئٍ، ‏‏‏‏‏‏وَهُبَيْرَةَ، ‏‏‏‏‏‏عَنْعَلِيٍّ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ لَمَّا خَرَجْنَا مِنْ مَكَّةَ تَبِعَتْنَا بِنْتُ حَمْزَةَ تُنَادِي يَا عَمُّ يَا عَمُّ، ‏‏‏‏‏‏فَتَنَاوَلَهَا عَلِيٌّ فَأَخَذَ بِيَدِهَا، ‏‏‏‏‏‏وَقَالَ:‏‏‏‏ دُونَكِ بِنْتَ عَمِّكِ فَحَمَلَتْهَا، ‏‏‏‏‏‏فَقَصَّ الْخَبَرَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ وَقَالَ جَعْفَرٌ:‏‏‏‏ ابْنَةُ عَمِّي وَخَالَتُهَا تَحْتِي، ‏‏‏‏‏‏فَقَضَى بِهَا النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِخَالَتِهَا، ‏‏‏‏‏‏وَقَالَ:‏‏‏‏ الْخَالَةُ بِمَنْزِلَةِ الْأُمِّ .

Urdu Translation

علی رضی اللہ عنہ کہتے ہیں کہ   جب ہم مکہ سے نکلے تو ہمارے پیچھے پیچھے حمزہ کی لڑکی چچا چچا پکارتی آ گئی، علی رضی اللہ عنہ ہاتھ پکڑ کر اسے اپنے ساتھ لے آئے اور ( فاطمہ رضی اللہ عنہا سے ) کہا: اپنے چچا کی لڑکی کو لو، انہوں نے اسے اٹھا لیا، راوی نے پھر پورا قصہ بیان کیا اور کہا کہ: جعفر رضی اللہ عنہ کہنے لگے: یہ میرے چچا کی بیٹی ہے، اور اس کی خالہ میرے نکاح میں ہے چنانچہ رسول اللہ صلی اللہ علیہ وسلم نے خالہ کے حق میں فیصلہ دیا اور فرمایا: خالہ ماں کے درجے میں ہے ۔

English Translation

Narrated Ali ibn Abu Talib: When we came out from Makkah, Hamzah's daughter pursued us crying: My uncle. Ali lifted her and took her by the hand. (Addressing Fatimah he said: ) Take your uncle's daughter. She then lifted her. The narrator then transmitted the rest of the tradition. Jafar said: She is my uncle's daughter. Her maternal aunt is my wife. The Prophet صلی ‌اللہ ‌علیہ ‌وسلم decided in favour of her maternal aunt, and said: The maternal aunt is like mother.
