Sunan Abu Dawood 2284 - Divorce (Kitab Al-Talaq)

حَدَّثَنَا الْقَعْنَبِيُّ، ‏‏‏‏‏‏عَنْ مَالِكٍ، ‏‏‏‏‏‏عَنْ عَبْدِ اللَّهِ بْنِ يَزِيدَ مَوْلَى الْأَسْوَدِ بْنِ سُفْيَانَ، ‏‏‏‏‏‏عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، ‏‏‏‏‏‏عَنْفَاطِمَةَ بِنْتِ قَيْسٍ، ‏‏‏‏‏‏أَنَّ أَبَا عَمْرِو بْنَ حَفْصٍ طَلَّقَهَا الْبَتَّةَ وَهُوَ غَائِبٌ، ‏‏‏‏‏‏فَأَرْسَلَ إِلَيْهَا وَكِيلَهُ بِشَعِيرٍ فَتَسَخَّطَتْهُ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ وَاللَّهِ مَا لَكِ عَلَيْنَا مِنْ شَيْءٍ، ‏‏‏‏‏‏فَجَاءَتْ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرَتْ ذَلِكَ لَهُ، ‏‏‏‏‏‏فَقَالَ لَهَا:‏‏‏‏ لَيْسَ لَكِ عَلَيْهِ نَفَقَةٌ ، ‏‏‏‏‏‏وَأَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ شَرِيكٍ، ‏‏‏‏‏‏ثُمَّ قَالَ:‏‏‏‏ إِنَّ تِلْكَ امْرَأَةٌ يَغْشَاهَا أَصْحَابِي، ‏‏‏‏‏‏اعْتَدِّي فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ، ‏‏‏‏‏‏فَإِنَّهُ رَجُلٌ أَعْمَى، ‏‏‏‏‏‏تَضَعِينَ ثِيَابَكِ، ‏‏‏‏‏‏وَإِذَا حَلَلْتِ فَآذِنِينِي ، ‏‏‏‏‏‏قَالَتْ:‏‏‏‏ فَلَمَّا حَلَلْتُ ذَكَرْتُ لَهُ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ وَ أَبَا جَهْمٍ خَطَبَانِي، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ أَمَّا أَبُو جَهْمٍ، ‏‏‏‏‏‏فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ، ‏‏‏‏‏‏وَأَمَّا مُعَاوِيَةُ، ‏‏‏‏‏‏فَصُعْلُوكٌ لَا مَالَ لَهُ، ‏‏‏‏‏‏انْكِحِي أُسَامَةَ بْنَ زَيْدٍ ، ‏‏‏‏‏‏قَالَتْ:‏‏‏‏ فَكَرِهْتُهُ، ‏‏‏‏‏‏ثُمَّ قَالَ:‏‏‏‏ انْكِحِي أُسَامَةَ بْنَ زَيْدٍ ، ‏‏‏‏‏‏فَنَكَحْتُهُ فَجَعَلَ اللَّهُ تَعَالَى فِيهِ خَيْرًا كَثِيرًا وَاغْتَبَطْتُ بِهِ.

Urdu Translation

ابوسلمہ بن عبدالرحمٰن فاطمہ بنت قیس رضی اللہ عنہا کے بارے میں روایت کرتے ہیں کہ   ابوعمرو بن حفص رضی اللہ عنہ نے انہیں طلاق بتہ دے دی ۱؎ ابوعمرو موجود نہیں تھے تو ان کے وکیل نے فاطمہ کے پاس کچھ جو بھیجے، اس پر وہ برہم ہوئیں، تو اس نے کہا: اللہ کی قسم! تمہارا ہم پر کوئی حق نہیں بنتا، تو وہ رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئیں اور ماجرا بیان کیا تو آپ صلی اللہ علیہ وسلم نے فاطمہ سے فرمایا: اس کے ذمہ تمہارا نفقہ نہیں ہے پھر آپ صلی اللہ علیہ وسلم نے انہیں ام شریک کے گھر میں عدت گزارنے کا حکم دیا، پھر آپ صلی اللہ علیہ وسلم نے فرمایا: یہ ایک ایسی عورت ہے کہ اس کے پاس میرے صحابہ کا اکثر آنا جانا لگا رہتا ہے، لہٰذا تم ابن ام مکتوم کے گھر میں عدت گزارو کیونکہ وہ نابینا ہیں، پردے کی دقت نہ ہو گی، تم اپنے کپڑے اتار سکو گی، اور جب عدت مکمل ہو جائے تو مجھے اطلاع دینا ۔ فاطمہ رضی اللہ عنہا کا بیان ہے کہ جب عدت گزر گئی تو میں نے رسول اللہ صلی اللہ علیہ وسلم کے سامنے معاویہ بن ابی سفیان اور ابوجہم رضی اللہ عنہما کے پیغام کا ذکر کیا، آپ صلی اللہ علیہ وسلم نے فرمایا: رہے ابوجہم تو وہ کندھے سے لاٹھی ہی نہیں اتارتے ( یعنی بہت زدو کوب کرنے والے شخص ہیں ) اور جہاں تک معاویہ کا سوال ہے تو وہ کنگال ہیں، ان کے پاس مال نہیں ہے۲؎، لہٰذا تم اسامہ بن زید سے نکاح کر لو ، فاطمہ رضی اللہ عنہا کا بیان ہے کہ وہ مجھے پسند نہیں آئے، آپ صلی اللہ علیہ وسلم نے پھر فرمایا کہ اسامہ بن زید سے نکاح کر لو، چنانچہ میں نے اسامہ سے نکاح کر لیا تو اللہ تعالیٰ نے اس میں اس قدر بھلائی رکھی کہ لوگ مجھ پر رشک کرنے لگے۔

English Translation

Abu Salamah bin Abd Al Rahman reported on the authority of Fatimah daughter of Qais Abu Amr bin Hafs divorced her (Fathima daughter of Qais) absolutely when he was away from home and his agent sent her home barely. She was displeased with it. He said “I swear by Allaah, you have no claim on us. She then came to Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم and mentioned that to him. He said to her “No maintenance is due to you for from him. He ordered her to spend the waiting period in the house of Umm Sharik but he said afterwards “that is a woman whom my Companions visits spend the waiting period in the house of Ibn Umm Maktum for he is blind and you can undress. Then when you are in a position of being remarried, tell me. ” She said “When I was in a position to remarry, I mentioned to him that Muawiyah bin Abi Sufyan and Abu Jahm had asked me in marriage. The Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلمsaid “As for Abu Jahm, he does not put down his stick from his shoulder, and as for Muawiyah he is a poor man who has no property; marry Usamah bin Zaid. I disliked him but he said “Maary Usamah bin Zaid. So, I married him. And Allaah prospered him very much and I was envied. ”
