حَدَّثَنَا الْقَعْنَبِيُّ، ‏‏‏‏‏‏عَنْ مَالِكٍ، ‏‏‏‏‏‏عَنْ ابْنِ شِهَابٍ، ‏‏‏‏‏‏عَنْ عُثْمَانَ بْنِ إِسْحَاق بْنِ خَرَشَةَ، ‏‏‏‏‏‏عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ، ‏‏‏‏‏‏أَنَّهُ قَالَ:‏‏‏‏ جَاءَتِ الْجَدَّةُ إِلَى أَبِي بَكْرٍ الصِّدِّيقِ تَسْأَلُهُ مِيرَاثَهَا، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ مَا لَكِ فِي كِتَابِ اللَّهِ تَعَالَى شَيْءٌ، ‏‏‏‏‏‏وَمَا عَلِمْتُ لَكِ فِي سُنَّةِ نَبِيِّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ شَيْئًا، ‏‏‏‏‏‏فَارْجِعِي حَتَّى أَسْأَلَ النَّاسَ، ‏‏‏‏‏‏فَسَأَلَ النَّاسَ، ‏‏‏‏‏‏فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ:‏‏‏‏ حَضَرْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَعْطَاهَا السُّدُسَ، ‏‏‏‏‏‏فَقَالَ أَبُو بَكْرٍ:‏‏‏‏ هَلْ مَعَكَ غَيْرُكَ ؟، ‏‏‏‏‏‏فَقَامَ مُحَمَّدُ بْنُ مَسْلَمَةَ فَقَالَ:‏‏‏‏ مِثْلَ مَا قَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ فَأَنْفَذَهُ لَهَا أَبُو بَكْرٍ، ‏‏‏‏‏‏ثُمَّ جَاءَتِ الْجَدَّةُ الأُخْرَى إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ تَسْأَلُهُ مِيرَاثَهَا، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ مَا لَكِ فِي كِتَابِ اللَّهِ تَعَالَى شَيْءٌ، ‏‏‏‏‏‏وَمَا كَانَ الْقَضَاءُ الَّذِي قُضِيَ بِهِ إِلَّا لِغَيْرِكِ وَمَا أَنَا بِزَائِدٍ فِي الْفَرَائِضِ، ‏‏‏‏‏‏وَلَكِنْ هُوَ ذَلِكَ السُّدُسُ فَإِنِ اجْتَمَعْتُمَا فِيهِ فَهُوَ بَيْنَكُمَا وَأَيَّتُكُمَا خَلَتْ بِهِ فَهُوَ لَهَا.

Urdu Translation

قبیصہ بن ذویب کہتے ہیں کہ   میت کی نانی ابوبکر صدیق رضی اللہ عنہ کے پاس میراث میں اپنا حصہ دریافت کرنے آئی تو انہوں نے کہا: اللہ کی کتاب ( قرآن پاک ) میں تمہارا کچھ حصہ نہیں ہے، اور مجھے نبی اکرم صلی اللہ علیہ وسلم کی سنت میں بھی تمہارے لیے کچھ نہیں معلوم، تم جاؤ میں لوگوں سے دریافت کر کے بتاؤں گا، پھر انہوں نے لوگوں سے پوچھا تو مغیرہ بن شعبہ رضی اللہ عنہ نے کہا کہ میں رسول اللہ صلی اللہ علیہ وسلم کے پاس موجود تھا، آپ نے اسے چھٹا حصہ دلایا ہے، اس پر ابوبکر رضی اللہ عنہ نے کہا: کیا تمہارے ساتھ کوئی اور بھی ہے ( جو اس معاملے کو جانتا ہو ) تو محمد بن مسلمہ رضی اللہ عنہ کھڑے ہوئے اور انہوں نے بھی وہی بات کہی جو مغیرہ رضی اللہ عنہ نے کہی تھی، تو ابوبکر رضی اللہ عنہ نے اس کے لیے اسی کو نافذ کر دیا، پھر عمر رضی اللہ عنہ کی خلافت میں دادی عمر رضی اللہ عنہ کے پاس اپنا میراث مانگنے آئی، عمر رضی اللہ عنہ نے کہا: اللہ کی کتاب ( قرآن ) میں تمہارے حصہ کا ذکر نہیں ہے اور پہلے ( رسول اللہ صلی اللہ علیہ وسلم اور ابوبکر رضی اللہ عنہ کے زمانہ میں ) جو حکم ہو چکا ہے وہ نانی کے معاملے میں ہوا ہے، میں اپنی طرف سے فرائض میں کچھ بڑھا نہیں سکتا، لیکن وہی چھٹا حصہ تم بھی لو، اگر نانی بھی ہو تو تم دونوں ( «سدس» ) کو بانٹ لو اور جو تم دونوں میں اکیلی ہو ( یعنی صرف نانی یا صرف دادی ) تو اس کے لیے وہی چھٹا حصہ ہے۔

English Translation

Narrated Qabisah ibn Dhuwayb: A grandmother came to Abu Bakr asking him for her share of inheritance. He said: There is nothing prescribed for you in Allah's Book, nor do I know anything for you in the Sunnah of the Prophet of Allah صلی ‌اللہ ‌علیہ ‌وسلم Go home till I question the people. He then questioned the people, and al-Mughirah ibn Shubah said: I had been present with the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم when he gave grandmother a sixth. Abu Bakr said: Is there anyone with you? Muhammad ibn Maslamah stood and said the same as al-Mughirah ibn Shubah had said. So Abu Bakr made it apply to her. Another grandmother came to Umar ibn al-Khattab asking him for her share of inheritance. He said: Nothing has been prescribed for you in Allah's Book. The decision made before you was made for a grandmother other than you. I am not going to add in the shares of inheritance; but it is that sixth. If there are two of you, it is shared between you, but whichever of you is the only one left gets it all.
