Sunan Abu Dawood 4434 - Prescribed Punishments (Kitab Al-Hudud)

Narrated Buraydah ibn al-Hasib: We, the Companions of the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم, used to talk mutually: Would that al-Ghamidiyyah and Maiz ibn Malik had withdrawn after their confession; or he said: Had they not withdrawn after their confession, he would not have pursued them (for punishment). He had them stoned after the fourth (confession).

حَدَّثَنَا أَحْمَدُ بْنُ إِسْحَاق الْأَهْوَازِيُّ ، ‏‏‏‏‏‏حَدَّثَنَا أَبُو أَحْمَدَ ، ‏‏‏‏‏‏حَدَّثَنَا بُشَيْرُ بْنُ الْمُهَاجِرِ ، ‏‏‏‏‏‏حَدَّثَنِي عَبْدُ اللَّهِ بْنُ بُرَيْدَةَ ، ‏‏‏‏‏‏عَنْ أَبِيهِ ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ كُنَّا أَصْحَابَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَتَحَدَّثُ:‏‏‏‏ أَنَّ الْغَامِدِيَّةَ، ‏‏‏‏‏‏وَمَاعِزَ بْنَ مَالِكٍ لَوْ رَجَعَا بَعْدَ اعْتِرَافِهِمَا، ‏‏‏‏‏‏أَوْ قَالَ:‏‏‏‏ لَوْ لَمْ يَرْجِعَا بَعْدَ اعْتِرَافِهِمَا لَمْ يَطْلُبْهُمَا، ‏‏‏‏‏‏وَإِنَّمَا رَجَمَهُمَا عِنْدَ الرَّابِعَةِ .

بریدہ رضی اللہ عنہ کہتے ہیں کہ   ہم رسول اللہ صلی اللہ علیہ وسلم کے اصحاب کا ذکر کیا کرتے تھے کہ غامدیہ ۱؎ اور ماعز بن مالک رضی اللہ عنہما دونوں اگر اقرار سے پھر جاتے، یا اقرار کے بعد پھر اقرار نہ کرتے تو آپ ان دونوں کو سزا نہ دیتے، آپ صلی اللہ علیہ وسلم نے ان دونوں کو اس وقت رجم کیا جب وہ چار چار بار اقرار کر چکے تھے ( اور ان کے اقرار میں کسی طرح کا کوئی شک باقی نہیں رہ گیا تھا ) ۔
