حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ، ‏‏‏‏‏‏حَدَّثَنَا هِشَامٌ. ح وحَدَّثَنَا مُسَدَّدٌ، ‏‏‏‏‏‏حَدَّثَنَا يَحْيَى، ‏‏‏‏‏‏عَنْ هِشَامٍ الْمَعْنَى، ‏‏‏‏‏‏عَنْ قَتَادَةَ، ‏‏‏‏‏‏عَنْ أَنَسِ بْنِ مَالِكٍ، ‏‏‏‏‏‏ أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ جَلَدَ فِي الْخَمْرِ بِالْجَرِيدِ وَالنِّعَالِ وَجَلَدَ أَبُو بَكْرٍ رَضِيَ اللَّهُ عَنْهُ أَرْبَعِينَ، ‏‏‏‏‏‏فَلَمَّا وُلِّيَ عُمَرُ دَعَا النَّاسَ، ‏‏‏‏‏‏فَقَالَ لَهُمْ:‏‏‏‏ إِنَّ النَّاسَ قَدْ دَنَوْا مِنَ الرِّيفِ، ‏‏‏‏‏‏وَقَالَ مُسَدَّدٌ:‏‏‏‏ مِنَ الْقُرَى وَالرِّيفِ فَمَا تَرَوْنَ فِي حَدِّ الْخَمْرِ ؟ فَقَالَ لَهُ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ:‏‏‏‏ نَرَى أَنْ تَجْعَلَهُ كَأَخَفِّ الْحُدُودِ فَجَلَدَ فِيهِ ثَمَانِينَ ، ‏‏‏‏‏‏قَالَ أَبُو دَاوُد:‏‏‏‏ رَوَاهُ ابْنُ أَبِي عَرُوبَةَ عَنْ قَتَادَةَ، ‏‏‏‏‏‏عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ جَلَدَ بِالْجَرِيدِ وَالنِّعَالِ أَرْبَعِينَ، ‏‏‏‏‏‏وَرَوَاهُ شُعْبَةُ عَنْ قَتَادَةَ، ‏‏‏‏‏‏عَنْ أَنَسٍ، ‏‏‏‏‏‏عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ ضَرَبَ بِجَرِيدَتَيْنِ نَحْوَ الْأَرْبَعِينَ.

Urdu Translation

انس بن مالک رضی اللہ عنہ سے روایت ہے کہ   نبی اکرم صلی اللہ علیہ وسلم نے شراب پینے پر کھجور کی ٹہنیوں اور جوتوں سے مارا، اور ابوبکر رضی اللہ عنہ نے چالیس کوڑے لگائے، پھر جب عمر رضی اللہ عنہ خلیفہ ہوئے تو آپ نے لوگوں کو بلایا، اور ان سے کہا: لوگ گاؤں سے قریب ہو گئے ہیں ( اور مسدد کی روایت میں ہے ) بستیوں اور گاؤں سے قریب ہو گئے ہیں ( یعنی شراب زیادہ پینے لگے ہیں ) تو اب شراب کی حد کے بارے میں تمہاری کیا رائے ہے؟ تو عبدالرحمٰن بن عوف نے ان سے کہا: ہماری رائے یہ ہے کہ سب سے ہلکی جو حد ہے وہی آپ اس میں مقرر کر دیں، چنانچہ اسی ( ۸۰ ) کوڑے مارنے کا حکم ہوا ( کیونکہ سب سے ہلکی حد یہی حدقذف تھی ) ۔ ابوداؤد کہتے ہیں: اسے ابن ابی عروبہ نے قتادہ سے، قتادہ نے نبی اکرم صلی اللہ علیہ وسلم سے مرفوعاً روایت کیا ہے کہ آپ صلی اللہ علیہ وسلم نے کھجور کی ٹہنیوں اور جوتوں سے چالیس مار ماریں۔ اور اسے شعبہ نے قتادہ سے، قتادہ نے نبی اکرم صلی اللہ علیہ وسلم سے روایت کیا ہے کہ آپ نے کھجور کی دو ٹہنیوں سے چالیس کے قریب مار ماریں۔

English Translation

Anas bin Malik said: The Prophet صلی ‌اللہ ‌علیہ ‌وسلم gave a beating with palm-branches and sandals for drinking wine and Abu Bakr gave lashes. When Umar came to power, he called upon people and said to them: The people are living now near watering placing, and, according to Musaddad’s version, “near villages and watering places, so what do you say about the punishment for (drinking) wine? Abdur-Rahman bin Awf said: We think that you should prescribe the lightest punishment. So he fixed eight lashes for it. Abu Dawud said: It has also been transmitted by Ibn Al 'Arubah from Qatadah from the Prophet صلی ‌اللہ ‌علیہ ‌وسلم to the effect that he gave a beating forty times with palm branches and sandals. And Shubah narrated it from Qatadah on the authority of Anas from Prophet صلی ‌اللہ ‌علیہ ‌وسلم. This version has: He gave a beating with two palm-branches about forty times.
