حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، ‏‏‏‏‏‏وَهَارُونُ بْنُ عَبَّادٍ الْأَزْدِيُّ الْمَعْنَى، ‏‏‏‏‏‏قَالَا:‏‏‏‏ حَدَّثَنَا وَكِيعٌ، ‏‏‏‏‏‏عَنْ هِشَامٍ، ‏‏‏‏‏‏عَنْ عُرْوَةَ، ‏‏‏‏‏‏عَنِالْمِسْوَرِ بْنِ مَخْرَمَةَ:‏‏‏‏ أَنّ عُمَرَ اسْتَشَارَ النَّاسَ فِي إِمْلَاصِ الْمَرْأَةِ، ‏‏‏‏‏‏فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ:‏‏‏‏ شَهِدْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَضَى فِيهَا بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ ائْتِنِي بِمَنْ يَشْهَدُ مَعَكَ، ‏‏‏‏‏‏فَأَتَاهُ بِمُحَمَّدِ بْنِ مَسْلَمَةَ، ‏‏‏‏‏‏زَادَ هَارُونُ:‏‏‏‏ فَشَهِدَ لَهُ يَعْنِي ضَرْبَ الرَّجُلِ بَطْنَ امْرَأَتِهِ ، ‏‏‏‏‏‏قَالَ أَبُو دَاوُد:‏‏‏‏ بَلَغَنِي عَنْ أَبِي عُبَيْدٍ، ‏‏‏‏‏‏إِنَّمَا سُمِّيَ إِمْلَاصًا لِأَنَّ الْمَرْأَةَ تُزْلِقُهُ قَبْلَ وَقْتِ الْوِلَادَةِ، ‏‏‏‏‏‏وَكَذَلِكَ كُلُّ مَا زَلَقَ مِنَ الْيَدِ وَغَيْرِهِ فَقَدْ مَلِصَ.

Urdu Translation

مسور بن مخرمہ رضی اللہ عنہما سے روایت ہے کہ   عمر رضی اللہ عنہ نے عورت کے املاص کے بارے میں لوگوں سے مشورہ لیا تو مغیرہ بن شعبہ رضی اللہ عنہ نے کہا: میں نے رسول اللہ صلی اللہ علیہ وسلم کو دیکھا کہ آپ نے اس میں ایک غلام یا لونڈی دینے کا فیصلہ کیا ہے، تو عمر نے کہا: میرے پاس اپنے ساتھ اس شخص کو لاؤ جو اس کی گواہی دے، تو وہ محمد بن مسلمہ رضی اللہ عنہ کو لے کر ان کے پاس آئے۔ ہارون کی روایت میں اتنا اضافہ ہے تو انہوں نے اس کی گواہی دی یعنی اس بات کی کہ کوئی آدمی عورت کے پیٹ میں مارے جو اسقاط حمل کا سبب بن جائے۔ ابوداؤد کہتے ہیں: مجھے ابو عبید سے معلوم ہوا اسقاط حمل کو املاص اس لیے کہتے ہیں کہ اس کے معنی ازلاق یعنی پھسلانے کے ہیں گویا عورت ولادت سے قبل ہی مار کی وجہ سے حمل کو پھسلا دیتی ہے اسی طرح ہاتھ یا کسی اور چیز سے جو چیز پھسل کر گر جائے تو اس کی تعبیر «مَلِصَ» سے کی جاتی ہے یعنی وہ پھسل گیا۔

English Translation

Narrated Al-Miswar bin Makhramah: Umar consulted the people about the compensation of abortion of woman. Al-Mughirah bin Shubah said: I was present with the Messenger of Allah صلی ‌اللہ ‌علیہ ‌وسلم when he gave judgement that a male or female slave should testify you. So he brought Muhammad bin Maslamah to him. Harun added: He then testified him. Imlas means a man striking the belly of his wife. Abu Dawud said: I have been informed that Abu Ubaid said: It (abortion) is called imlas because the woman causes it to slip before the time of delivery. Similarly, anything which slips from the hand or from some other thing is called malasa (slipped).
