حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا الْمُعْتَمِرُ، عَنْ حُمَيْدٍ الطَّوِيلِ، عَنْ أَنَسِ بْنِ مَالِكٍ، قَالَ: كَسَرَتِ الرُّبَيِّعُ أُخْتُ أَنَسِ بْنِ النَّضْرِ ثَنِيَّةَ امْرَأَةٍ، فَأَتَوْا النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَضَى بِكِتَابِ اللَّهِ الْقِصَاصَ، فَقَالَ أَنَسُ بْنُ النَّضْرِ: وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا تُكْسَرُ ثَنِيَّتُهَا الْيَوْمَ، قَالَ: يَا أَنَسُ كِتَابُ اللَّهِ الْقِصَاصُ، فَرَضُوا بِأَرْشٍ أَخَذُوهُ، فَعَجِبَ نَبِيُّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَقَالَ: إِنَّ مِنْ عِبَادِ اللَّهِ مَنْ لَوْ أَقْسَمَ عَلَى اللَّهِ لَأَبَرَّهُ ، قَالَ أَبُو دَاوُد: سَمِعْتُ أَحْمَدَ بْنَ حَنْبَلٍ، قِيلَ لَهُ: كَيْفَ يُقْتَصُّ مِنَ السِّنِّ ؟ قَالَ: تُبْرَدُ.
انس بن مالک رضی اللہ عنہ کہتے ہیں کہ انس بن نضر رضی اللہ عنہ کی بہن ربیع نے ایک عورت کا سامنے کا دانت توڑ دیا، تو وہ لوگ نبی اکرم صلی اللہ علیہ وسلم کے پاس آئے، آپ نے اللہ کی کتاب کے مطابق قصاص کا فیصلہ کیا، تو انس بن نضر نے کہا، اس ذات کی قسم جس نے آپ کو حق کے ساتھ بھیجا ہے! اس کا دانت تو آج نہیں توڑا جائے گا، آپ صلی اللہ علیہ وسلم نے فرمایا: اے انس! کتاب اللہ میں قصاص کا حکم ہے پھر وہ لوگ دیت پر راضی ہو گئے جسے انہوں نے لے لیا، اس پر اللہ کے نبی اکرم صلی اللہ علیہ وسلم کو تعجب ہوا اور آپ نے فرمایا: اللہ کے بعض بندے ایسے ہیں کہ اگر وہ اللہ کی قسم کھا لیں تو وہ ان کی قسم پوری کر دیتا ہے ۱؎ ۔ ابوداؤد کہتے ہیں: میں نے احمد بن حنبل کو کہتے سنا ان سے پوچھا گیا تھا کہ دانت کا قصاص کیسے لیا جائے؟ تو انہوں نے کہا: وہ ریتی سے رگڑا جائے۔
Narrated Anas bin Malik: Al-Rubayyi, sister of Anas bin al-Nadr, broke (one of) the front teeth of a woman. They came to the Prophet صلی اللہ علیہ وسلم. He made a decision in accordance with the Book of Allah that retaliation should be taken. Anas bin al-Nadr said: I swear by Him who has sent you the truth, her front tooth will not be broken today. He replied: Anas! Allah's decree is retaliation. But the people were agreeable to accepting a fine, so the Prophet صلی اللہ علیہ وسلم said: Among Allah's servants there are those who, if they adjured Allah, He (Allah) would consent to it. Abu Dawud said: I heard Ahmad bin Hanbal say: He was asked: How retaliation of a tooth is taken ? He said: It is broken with a file.
