حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ مُحَمَّدِ بْنِ عَمْرٍو، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ الْيَتِيمَةُ تُسْتَأْمَرُ فِي نَفْسِهَا، ‏‏‏‏‏‏فَإِنْ صَمَتَتْ فَهُوَ إِذْنُهَا، ‏‏‏‏‏‏وَإِنْ أَبَتْ فَلَا جَوَازَ عَلَيْهَا . يَعْنِي:‏‏‏‏ إِذَا أَدْرَكَتْ فَرَدَّتْ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ أَبِي مُوسَى، ‏‏‏‏‏‏وَابْنِ عُمَرَ، ‏‏‏‏‏‏وَعَائِشَةَ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ، ‏‏‏‏‏‏وَاخْتَلَفَ أَهْلُ الْعِلْمِ فِي تَزْوِيجِ الْيَتِيمَةِ، ‏‏‏‏‏‏فَرَأَى بَعْضُ أَهْلِ الْعِلْمِ أَنَّ الْيَتِيمَةَ إِذَا زُوِّجَتْ فَالنِّكَاحُ مَوْقُوفٌ حَتَّى تَبْلُغَ، ‏‏‏‏‏‏فَإِذَا بَلَغَتْ فَلَهَا الْخِيَارُ فِي إِجَازَةِ النِّكَاحِ أَوْ فَسْخِهِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ بَعْضِ التَّابِعِينَ وَغَيْرِهِمْ، ‏‏‏‏‏‏وقَالَ بَعْضُهُمْ:‏‏‏‏ لَا يَجُوزُ نِكَاحُ الْيَتِيمَةِ حَتَّى تَبْلُغَ، ‏‏‏‏‏‏وَلَا يَجُوزُ الْخِيَارُ فِي النِّكَاحِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ سُفْيَانَ الثَّوْرِيِّ، ‏‏‏‏‏‏وَالشَّافِعِيِّ، ‏‏‏‏‏‏وَغَيْرِهِمَا مِنْ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏وقَالَ أَحْمَدُ، ‏‏‏‏‏‏وَإِسْحَاق:‏‏‏‏ إِذَا بَلَغَتِ الْيَتِيمَةُ تِسْعَ سَنِينَ فَزُوِّجَتْ فَرَضِيَتْ فَالنِّكَاحُ جَائِزٌ، ‏‏‏‏‏‏وَلَا خِيَارَ لَهَا إِذَا أَدْرَكَتْ، ‏‏‏‏‏‏وَاحْتَجَّا بِحَدِيثِ عَائِشَةَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَنَى بِهَا وَهِيَ بِنْتُ تِسْعِ سِنِينَ ، ‏‏‏‏‏‏وَقَدْ قَالَتْ عَائِشَةُ:‏‏‏‏ إِذَا بَلَغَتِ الْجَارِيَةُ تِسْعَ سِنِينَ فَهِيَ امْرَأَةٌ.

Urdu Translation

ابوہریرہ رضی الله عنہ کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”یتیم لڑکی سے اس کی رضا مندی حاصل کی جائے گی، اگر وہ خاموش رہی تو یہی اس کی رضا مندی ہے، اور اگر اس نے انکار کیا تو اس پر ( زبردستی کرنے کا ) کوئی جواز نہیں“۔ امام ترمذی کہتے ہیں: ۱- ابوہریرہ رضی الله عنہ کی حدیث حسن ہے، ۲- اس باب میں ابوموسیٰ، ابن عمر، اور عائشہ رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- یتیم لڑکی کی شادی کے سلسلے میں اہل علم نے اختلاف کیا ہے۔ بعض اہل علم کا خیال ہے: یتیم لڑکی کی جب شادی کر دی جائے تو نکاح موقوف رہے گا۔ یہاں تک کہ وہ بالغ ہو جائے۔ جب وہ بالغ ہو جائے گی، تو اسے نکاح کو باقی رکھنے یا اسے فسخ کر دینے کا اختیار ہو گا۔ یہی بعض تابعین اور دیگر علماء کا بھی قول ہے، ۴- اور بعض کہتے ہیں: یتیم لڑکی کا نکاح جب تک وہ بالغ نہ ہو جائے، درست نہیں اور نکاح میں «خیار» جائز نہیں، اور اہل علم میں سے سفیان ثوری، شافعی وغیرہم کا یہی قول ہے، ۵- احمد اور اسحاق بن راہویہ کہتے ہیں کہ جب یتیم لڑکی نو سال کی ہو جائے اور اس کا نکاح کر دیا جائے، اور وہ اس پر راضی ہو تو نکاح درست ہے اور بالغ ہونے کے بعد اسے اختیار نہیں ہو گا۔ ان دونوں نے عائشہ کی اس حدیث سے دلیل لی ہے کہ نبی اکرم صلی اللہ علیہ وسلم نے جب ان کے ساتھ شب زفاف منائی، تو وہ نو برس کی تھیں۔ اور عائشہ رضی الله عنہا کا قول ہے کہ لڑکی جب نو برس کی ہو جائے تو وہ عورت ہے۔

English Translation

Abu Hurairah narrated that: The Messenger of Allah said: An orphan is to be consulted about herself, then if she is silent that is her permission, and if she refuses, then do not authorize it (the marriage) for her (meaning: when she attains the age of puberty and refuses it.)
