حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ، أَخْبَرَنَا الْوَلِيدُ بْنُ مُسْلِمٍ، عَنْ زُهَيْرِ بْنِ مُحَمَّدٍ، عَنْ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ أَيُّمَا عَبْدٍ تَزَوَّجَ بِغَيْرِ إِذْنِ سَيِّدِهِ فَهُوَ عَاهِرٌ . قَالَ:‏‏‏‏ وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ ابْنِ عُمَرَ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ جَابِرٍ حَدِيثٌ حَسَنٌ، ‏‏‏‏‏‏وَرَوَى بَعْضُهُمْ هَذَا الْحَدِيثَ عَنْ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ، عَنْ ابْنِ عُمَرَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَلَا يَصِحُّ، ‏‏‏‏‏‏وَالصَّحِيحُ عَنْ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ، ‏‏‏‏‏‏عَنْ جَابِرٍ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، ‏‏‏‏‏‏أَنَّ نِكَاحَ الْعَبْدِ بِغَيْرِ إِذْنِ سَيِّدِهِ لَا يَجُوزُ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ أَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏وَغَيْرِهِمَا بِلَا اخْتِلَافٍ.

Urdu Translation

جابر بن عبداللہ رضی الله عنہما سے روایت ہے کہ   نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”جو غلام اپنے مالک کی اجازت کے بغیر شادی کر لے، وہ زانی ہے“۔ امام ترمذی کہتے ہیں: ۱- جابر کی حدیث حسن ہے، ۲- بعض نے اس حدیث کو بسند «عبد الله بن محمد بن عقيل عن ابن عمر عن النبي صلى الله عليه وسلم» روایت کیا ہے، اور یہ صحیح نہیں ہے، صحیح یہ ہے کہ عبداللہ بن محمد بن عقیل نے جابر سے روایت کی ہے، ۳- اس باب میں ابن عمر رضی الله عنہما سے بھی حدیث آئی ہے، ۴- صحابہ کرام وغیرہم میں سے اہل علم کا اسی پر عمل ہے کہ مالک کی اجازت کے بغیر غلام کا نکاح کرنا جائز نہیں۔ یہی احمد اور اسحاق بن راہویہ وغیرہ کا بھی قول ہے، اس میں کوئی اختلاف نہیں۔

English Translation

Jabir bin Abdullah narrated that: The Prophet said: Whichever slave gets married without the permission of his owner, then he is a fornicator.
