حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا ابْنُ لَهِيعَةَ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ أَيُّمَا رَجُلٍ نَكَحَ امْرَأَةً، ‏‏‏‏‏‏فَدَخَلَ بِهَا فَلَا يَحِلُّ لَهُ نِكَاحُ ابْنَتِهَا، ‏‏‏‏‏‏وَإِنْ لَمْ يَكُنْ دَخَلَ بِهَا فَلْيَنْكِحْ ابْنَتَهَا، ‏‏‏‏‏‏وَأَيُّمَا رَجُلٍ نَكَحَ امْرَأَةً فَدَخَلَ بِهَا أَوْ لَمْ يَدْخُلْ بِهَا فَلَا يَحِلُّ لَهُ نِكَاحُ أُمِّهَا . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ لَا يَصِحُّ مِنْ قِبَلِ إِسْنَادِهِ، ‏‏‏‏‏‏وَإِنَّمَا رَوَاهُ ابْنُ لَهِيعَةَ، ‏‏‏‏‏‏وَالْمُثَنَّى بْنُ الصَّبَّاحِ، ‏‏‏‏‏‏عَنْ عَمْرِو بْنِ شُعَيْبٍ، ‏‏‏‏‏‏وَالْمُثَنَّى بْنُ الصَّبَّاحِ، ‏‏‏‏‏‏وَابْنُ لَهِيعَةَ يضعفان في الحديث، ‏‏‏‏‏‏والعمل على هذا عند أكثر أهل العلم، ‏‏‏‏‏‏قَالُوا:‏‏‏‏ إِذَا تَزَوَّجَ الرَّجُلُ امْرَأَةً ثُمَّ طَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا حَلَّ لَهُ أَنْ يَنْكِحَ ابْنَتَهَا، ‏‏‏‏‏‏وَإِذَا تَزَوَّجَ الرَّجُلُ الِابْنَةَ فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا لَمْ يَحِلَّ لَهُ نِكَاحُ أُمِّهَا، ‏‏‏‏‏‏لِقَوْلِ اللَّهِ تَعَالَى:‏‏‏‏ وَأُمَّهَاتُ نِسَائِكُمْ سورة النساء آية 23 وَهُوَ قَوْلُ:‏‏‏‏ الشَّافِعِيِّ، ‏‏‏‏‏‏وَأَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق.

Urdu Translation

عبداللہ بن عمرو رضی الله عنہما کہتے ہیں کہ   نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”جس شخص نے کسی عورت سے نکاح کیا اور اس کے ساتھ دخول کیا تو اس کے لیے اس کی بیٹی سے نکاح کرنا درست نہیں ہے، اور اگر اس نے اس کے ساتھ دخول نہیں کیا ہے تو وہ اس کی بیٹی سے نکاح کر سکتا ہے، اور جس مرد نے کسی عورت سے نکاح کیا تو اس نے اس سے دخول کیا ہو یا نہ کیا ہو اس کے لیے اس کی ماں سے نکاح کرنا حلال نہیں ہو گا“۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث سند کے اعتبار سے صحیح نہیں ہے، اسے صرف ابن لہیعہ اور مثنی بن صالح نے عمرو بن شعیب سے روایت کیا ہے۔ اور مثنی بن صالح اور ابن لہیعہ حدیث کے سلسلے میں ضعیف قرار دیے جاتے ہیں۔ ۲- اکثر اہل علم کا اسی پر عمل ہے۔ وہ کہتے ہیں کہ جب آدمی کسی کی ماں سے شادی کر لے اور پھر اسے دخول سے پہلے طلاق دیدے تو اس کے لیے اس کی بیٹی سے نکاح جائز ہے، اور جب آدمی کسی کی بیٹی سے نکاح کرے اور اسے دخول سے پہلے طلاق دیدے تو اس کے لیے اس کی ماں سے نکاح جائز نہیں ہے اس لیے کہ اللہ تعالیٰ کا ارشاد ہے «وأمهات نسائكم» ( النساء: ۲۳ ) ، یہی شافعی، احمد اور اسحاق بن راہویہ کا قول ہے۔

English Translation

Amr bin Shu'aib narrated from his father, from his grandfather that: The Prophet said: Whichever man married a woman and entered into her, then it is not lawful for him to marry her daughter. If he did not enter into her then he may marry her daughter. And whichever man married a woman and he entered into her, or he did not enter into her, then it is not lawful for him to marry her mother.
