Baab Nikah Ke Ehkaam O Masail

حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ، عَنْ الزُّهْرِيِّ، عَنْ عَبْدِ اللَّهِ، وَالْحَسَنِ ابني محمد بن علي، ‏‏‏‏‏‏عَنْ أَبِيهِمَا، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ مُتْعَةِ النِّسَاءِ وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ زَمَنَ خَيْبَرَ . قَالَ:‏‏‏‏ وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ سَبْرَةَ الْجُهَنِيِّ، ‏‏‏‏‏‏وَأَبِي هُرَيْرَةَ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ عَلِيٍّ حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، ‏‏‏‏‏‏وَإِنَّمَا رُوِيَ عَنْ ابْنِ عَبَّاسٍ شَيْءٌ مِنَ الرُّخْصَةِ فِي الْمُتْعَةِ، ‏‏‏‏‏‏ثُمَّ رَجَعَ عَنْ قَوْلِهِ حَيْثُ أُخْبِرَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏وَأَمْرُ أَكْثَرِ أَهْلِ الْعِلْمِ عَلَى تَحْرِيمِ الْمُتْعَةِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ الثَّوْرِيِّ، ‏‏‏‏‏‏وَابْنِ الْمُبَارَكِ، ‏‏‏‏‏‏وَالشَّافِعِيِّ، ‏‏‏‏‏‏وَأَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق.

Urdu Translation

علی رضی الله عنہ کہتے ہیں کہ   نبی اکرم صلی اللہ علیہ وسلم نے خیبر کی فتح کے وقت عورتوں سے متعہ ۱؎ کرنے سے اور گھریلو گدھوں کے گوشت کھانے سے منع فرمایا۔ امام ترمذی کہتے ہیں: ۱- علی رضی الله عنہ کی حدیث حسن صحیح ہے، ۲- اس باب میں سبرہ جہنی اور ابوہریرہ رضی الله عنہ سے بھی احادیث آئی ہیں، ۳- صحابہ کرام وغیرہم میں سے اہل علم کا اسی پر عمل ہے، البتہ ابن عباس سے کسی قدر متعہ کی اجازت بھی روایت کی گئی ہے، پھر انہوں نے اس سے رجوع کر لیا جب انہیں نبی اکرم صلی اللہ علیہ وسلم کے بارے میں اس کی خبر دی گئی۔ اکثر اہل علم کا معاملہ متعہ کی حرمت کا ہے، یہی ثوری، ابن مبارک، شافعی، احمد اور اسحاق بن راہویہ کا بھی قول ہے۔

English Translation

Ali bin Abi Talib narrated: The Prophet prohibited the Mut'ah with women, and the meat of domestic donkeys during (the campaign of) Khaibar.
