Baab Nikah Ke Ehkaam O Masail

حَدَّثَنَا إِسْحَاق بْنُ مُوسَى الْأَنْصَارِيُّ، حَدَّثَنَا مَعْنٌ، حَدَّثَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنْ ابْنِ عُمَرَ، أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنِ الشِّغَارِ . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ عَامَّةِ أَهْلِ الْعِلْمِ لَا يَرَوْنَ نِكَاحَ الشِّغَارِ، ‏‏‏‏‏‏وَالشِّغَارُ أَنْ يُزَوِّجَ الرَّجُلُ ابْنَتَهُ عَلَى أَنْ يُزَوِّجَهُ الْآخَرُ ابْنَتَهُ أَوْ أُخْتَهُ، ‏‏‏‏‏‏وَلَا صَدَاقَ بَيْنَهُمَا، ‏‏‏‏‏‏وقَالَ بَعْضُ أَهْلِ الْعِلْمِ:‏‏‏‏ نِكَاحُ الشِّغَارِ مَفْسُوخٌ، ‏‏‏‏‏‏وَلَا يَحِلُّ وَإِنْ جُعِلَ لَهُمَا صَدَاقًا، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ الشَّافِعِيِّ، ‏‏‏‏‏‏وَأَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏وَرُوِيَ عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ، ‏‏‏‏‏‏أَنَّهُ قَالَ:‏‏‏‏ يُقَرَّانِ عَلَى نِكَاحِهِمَا وَيُجْعَلُ لَهُمَا صَدَاقُ الْمِثْلِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ أَهْلِ الْكُوفَةِ.

Urdu Translation

عبداللہ بن عمر رضی الله عنہما سے روایت ہے کہ   نبی اکرم صلی اللہ علیہ وسلم نے نکاح شغار سے منع فرمایا۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- اکثر اہل علم کا اسی پر عمل ہے، یہ لوگ نکاح شغار کو درست نہیں سمجھتے، ۳- شغار یہ ہے کہ آدمی اپنی بیٹی کا نکاح کسی سے اس شرط پر کرے کہ وہ بھی اپنی بیٹی یا بہن کا نکاح اس سے کر دے گا اور ان کے درمیان کوئی مہر مقرر نہ ہو، ۴- بعض اہل علم کہتے ہیں: نکاح شغار فسخ کر دیا جائے گا اور وہ حلال نہیں، اگرچہ بعد میں ان کے درمیان مہر مقرر کر لیا جائے۔ یہ شافعی، احمد اور اسحاق بن راہویہ کا قول ہے، ۵- لیکن عطاء بن ابی رباح کہتے ہیں کہ وہ اپنے نکاح پر قائم رہیں گے البتہ ان کے درمیان مہر مثل مقرر کر دیا جائے گا، اور یہی اہل کوفہ کا بھی قول ہے۔
