حَدَّثَنَا مُحَمَّدُ بْنُ وَزِيرٍ الْوَاسِطِيُّ،‏‏‏‏ حَدَّثَنَا إِسْحَاق بْنُ يُوسُفَ الْأَزْرَقُ،‏‏‏‏ عَنْ سُفْيَانَ،‏‏‏‏ عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ،‏‏‏‏ عَنْ نَافِعٍ،‏‏‏‏ عَنْ ابْنِ عُمَرَ،‏‏‏‏ قَالَ:‏‏‏‏ عُرِضْتُ عَلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي جَيْشٍ وَأَنَا ابْنُ أَرْبَعَ عَشْرَةَ،‏‏‏‏ فَلَمْ يَقْبَلْنِي،‏‏‏‏ فَعُرِضْتُ عَلَيْهِ مِنْ قَابِلٍ فِي جَيْشٍ وَأَنَا ابْنُ خَمْسَ عَشْرَةَ،‏‏‏‏ فَقَبِلَنِي . قَالَ نَافِعٌ:‏‏‏‏ وَحَدَّثْتُ بِهَذَا الْحَدِيثِ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ، ‏‏‏‏‏‏فَقَالَ:‏‏‏‏ هَذَا حَدُّ مَا بَيْنَ الصَّغِيرِ وَالْكَبِيرِ،‏‏‏‏ ثُمَّ كَتَبَ أَنْ يُفْرَضَ لِمَنْ يَبْلُغُ الْخَمْسَ عَشْرَةَ،‏‏‏‏ حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ،‏‏‏‏ عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ،‏‏‏‏ عَنْ نَافِعٍ،‏‏‏‏ عَنْ ابْنِ عُمَرَ،‏‏‏‏ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَ هَذَا،‏‏‏‏ وَلَمْ يَذْكُرْ فِيهِ أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ كَتَبَ أَنَّ هَذَا حَدُّ مَا بَيْنَ الصَّغِيرِ وَالْكَبِيرِ،‏‏‏‏ وَذَكَرَ ابْنُ عُيَيْنَةَ فِي حَدِيثِهِ،‏‏‏‏ قَالَ نَافِعٌ:‏‏‏‏ فَحَدَّثَنَا بِهِ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ فَقَالَ:‏‏‏‏ هَذَا حَدُّ مَا بَيْنَ الذُّرِّيَّةِ،‏‏‏‏ وَالْمُقَاتِلَةِ. قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ،‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ،‏‏‏‏ وَبِهِ يَقُولُ سُفْيَانُ الثَّوْرِيُّ،‏‏‏‏ وَابْنُ الْمُبَارَكِ،‏‏‏‏ وَالشَّافِعِيُّ،‏‏‏‏ وَأَحْمَدُ،‏‏‏‏ وَإِسْحَاق،‏‏‏‏ يَرَوْنَ أَنَّ:‏‏‏‏ الْغُلَامَ إِذَا اسْتَكْمَلَ خَمْسَ عَشْرَةَ سَنَةً،‏‏‏‏ فَحُكْمُهُ حُكْمُ الرِّجَالِ،‏‏‏‏ وَإِنِ احْتَلَمَ قَبْلَ خَمْسَ عَشْرَةَ،‏‏‏‏ فَحُكْمُهُ حُكْمُ الرِّجَالِ ،‏‏‏‏ وقَالَ أَحْمَدُ،‏‏‏‏ وَإِسْحَاق:‏‏‏‏ الْبُلُوغُ ثَلَاثَةُ مَنَازِلَ،‏‏‏‏ بُلُوغُ خَمْسَ عَشْرَةَ،‏‏‏‏ أَوِ الِاحْتِلَامُ،‏‏‏‏ فَإِنْ لَمْ يُعْرَفْ سِنُّهُ وَلَا احْتِلَامُهُ فَالْإِنْبَاتُ يَعْنِي الْعَانَةَ.

Urdu Translation

عبداللہ بن عمر رضی الله عنہما کہتے ہیں کہ   مجھے رسول اللہ صلی اللہ علیہ وسلم کے سامنے ایک لشکر میں پیش کیا گیا، اس وقت میری عمر چودہ سال کی تھی تو آپ نے مجھے ( لشکر میں ) قبول نہیں کیا، پھر آئندہ سال مجھے آپ کے سامنے ایک اور لشکر میں پیش کیا گیا اور اس وقت میری عمر پندرہ سال کی تھی تو آپ نے مجھے ( لشکر میں ) قبول کر لیا۔ نافع کہتے ہیں: میں نے عمر بن عبدالعزیز سے اس حدیث کو بیان کیا تو انہوں نے کہا: بالغ اور نابالغ کے درمیان یہی حد ہے۔ انہوں نے اپنے عاملوں کو لکھا کہ جو پندرہ سال کے ہو جائیں ( مال غنیمت سے ) ان کو حصہ دیا جائے۔ دوسری سند سے عمر نے نبی اکرم صلی اللہ علیہ وسلم سے اسی طرح کی حدیث روایت کی ہے اور اس میں یہ ذکر نہیں کیا کہ ( عمر بن عبدالعزیز نے اپنے عاملوں کو لکھا کہ نابالغ اور بالغ کی یہی حد ہے ) البتہ سفیان بن عیینہ نے اپنی حدیث میں یہ بیان کیا ہے کہ نافع کہتے ہیں کہ ہم نے اس حدیث کو عمر بن عبدالعزیز سے بیان کیا تو انہوں نے کہا: بچہ اور مقاتل ( جو جنگ میں شرکت کا اہل ہو ) کے درمیان یہی حد ہے۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- اہل علم کا اسی پر عمل ہے، سفیان ثوری، ابن مبارک، شافعی، احمد اور اسحاق بن راہویہ بھی اسی کے قائل ہیں۔ یہ لوگ کہتے ہیں کہ جب بچہ پندرہ سال مکمل کر لے تو اس کا حکم وہی ہو گا جو مردوں کا ہوتا ہے اور اگر پندرہ سال سے پہلے ہی اس کو احتلام آنے لگے تو بھی اس کا حکم مردوں جیسا ہو گا۔ احمد اور اسحاق بن راہویہ کہتے ہیں: بلوغت کی تین علامتیں ہیں: بچہ پندرہ سال کا ہو جائے، یا اس کو احتلام آنے لگے، اور اگر عمر اور احتلام نہ معلوم ہو سکے تو جب اس کے ناف کے نیچے کے بال اگ آئیں تو وہ بالغ ہے۔

English Translation

Narrated Nafi': that Ibn 'Umar said: I was reviewed before the Messenger of Allah (ﷺ) in the army, and I was fourteen years old, but he did not accept me. Then I was reviewed before him in the army later while I was fifteen years old, and he accepted me. Nafi' said: I narrated this Hadith to 'Uman bin 'Abdul Azeez and he said: 'This is the limit that distinguishes between childhood and adulthood.' Then he wrote to give salaries to whoever reached fifteen years old. (Another chain) from Nafi', from Ibn 'Umar from the Prophet (ﷺ) and it is similar, but he did not mention in it that 'Umar bin 'Abdul-'Aziz wrote that this is the limit that distinguishes between youth and childhood and adulthood. In his narration, Ibn 'Uyainah said (that Nafi' said): I narrated it to 'Umar bin 'Abdul-'Aziz and he said: 'This is the limit that distinguishes between children and soldiers.'
