حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ،‏‏‏‏ حَدَّثَنَا سُفْيَانُ،‏‏‏‏ عَنْ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ،‏‏‏‏ عَنْ أَبِي هُرَيْرَةَ، قَالَ:‏‏‏‏ قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ الْعَجْمَاءُ جَرْحُهَا جُبَارٌ،‏‏‏‏ وَالْبِئْرُ جُبَارٌ،‏‏‏‏ وَالْمَعْدِنُ جُبَارٌ، وَفِي الرِّكَازِ الْخُمُسُ . حَدَّثَنَا قُتَيْبَةُ،‏‏‏‏ حَدَّثَنَا اللَّيْثُ،‏‏‏‏ عَنْ ابْنِ شِهَابٍ،‏‏‏‏ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ،‏‏‏‏ وَأَبِي سَلَمَةَ،‏‏‏‏ عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَحْوَهُ. قَالَ:‏‏‏‏ وَفِي الْبَاب،‏‏‏‏ عَنْ جَابِرٍ،‏‏‏‏ وَعَمْرِو بْنِ عَوْفٍ الْمُزَنِيِّ،‏‏‏‏ وَعُبَادَةَ بْنِ الصَّامِتِ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ أَبِي هُرَيْرَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ. حَدَّثَنَا الْأَنْصَارِيُّ، ‏‏‏‏‏‏قَدَّ ثَنَا مَعْنٍ،‏‏‏‏ قَالَ:‏‏‏‏ أَخْبَرَنَا مَالِكُ بْنُ أَنَسٍ، ‏‏‏‏‏‏وَتَفْسِيرُ حَدِيثِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:‏‏‏‏ الْعَجْمَاءُ جَرْحُهَا جُبَارٌ ،‏‏‏‏ يَقُولُ هَدَرٌ:‏‏‏‏ لَا دِيَةَ فِيهِ،‏‏‏‏ قَالَ أَبُو عِيسَى:‏‏‏‏ وَمَعْنَى قَوْلِهِ الْعَجْمَاءُ:‏‏‏‏ جَرْحُهَا جُبَارٌ، فَسَّرَ ذَلِكَ بَعْضُ أَهْلِ الْعِلْمِ قَالُوا:‏‏‏‏ الْعَجْمَاءُ:‏‏‏‏ الدَّابَّةُ الْمُنْفَلِتَةُ مِنْ صَاحِبِهَا فَمَا أَصَابَتْ فِي انْفِلَاتِهَا فَلَا غُرْمَ عَلَى صَاحِبِهَا،‏‏‏‏ وَالْمَعْدِنُ جُبَارٌ، ‏‏‏‏‏‏يَقُولُ:‏‏‏‏ إِذَا احْتَفَرَ الرَّجُلُ مَعْدِنًا فَوَقَعَ فِيهِ إِنْسَانٌ فَلَا غُرْمَ عَلَيْهِ،‏‏‏‏ وَكَذَلِكَ الْبِئْرُ:‏‏‏‏ إِذَا احْتَفَرَهَا الرَّجُلُ لِلسَّبِيلِ فَوَقَعَ فِيهَا إِنْسَانٌ فَلَا غُرْمَ عَلَى صَاحِبِهَا. وَفِي الرِّكَازِ الْخُمُسُ،‏‏‏‏ وَالرِّكَازُ:‏‏‏‏ مَا وُجِدَ فِي دَفْنِ أَهْلِ الْجَاهِلِيَّةِ،‏‏‏‏ فَمَنْ وَجَدَ رِكَازًا،‏‏‏‏ أَدَّى مِنْهُ الْخُمُسَ إِلَى السُّلْطَانِ وَمَا بَقِيَ فَهُوَ لَهُ.

Urdu Translation

ابوہریرہ رضی الله عنہ کہتے ہیں کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”بےزبان ( جانور ) کا زخم رائیگاں ہے، کنویں اور کان میں گر کر کوئی مر جائے تو وہ بھی رائیگاں ہے ۱؎، اور جاہلیت کے دفینے میں پانچواں حصہ ہے“۔ مؤلف نے اپنی سند سے بطریق «عن ابن شهاب عن سعيد بن المسيب وأبي سلمة عن أبي هريرة عن النبي صلى الله عليه وسلم» اسی طرح کی حدیث روایت کی ہے۔ امام ترمذی کہتے ہیں: ۱- ابوہریرہ کی حدیث حسن صحیح ہے، ۲- اس باب میں جابر عمرو بن عوف مزنی اور عبادہ بن صامت رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- مالک بن انس کہتے ہیں کہ نبی اکرم صلی اللہ علیہ وسلم کی حدیث «العجماء جرحها جبار» کی تفسیر یہ ہے کہ چوپایوں سے لگے ہوئے زخم رائیگاں ہیں اس میں کوئی دیت نہیں ہے، ۴- «العجماء جرحها جبار» کی بعض علماء نے یہی تفسیر کی ہے، یہ لوگ کہتے ہیں کہ بےزبان جانور وہ ہیں جو اپنے مالک کے پاس سے بدک کر بھاگ جائیں، اگر ان کے بدک کر بھاگنے کی حالت میں کسی کو ان سے زخم لگے یا چوٹ آ جائے تو جانور والے پر کوئی تاوان نہیں ہو گا، ۵- «والمعدن جبار» کی تفسیر میں مالک کہتے ہیں: جب کوئی شخص کان کھدوائے اور اس میں کوئی گر جائے تو کان کھودوانے والے پر کوئی تاوان نہیں ہے، اسی طرح کنواں ہے جب کوئی مسافروں وغیرہ کے لیے کنواں کھدوائے اور اس میں کوئی شخص گر جائے تو کھدوائے والے پر کوئی تاوان نہیں ہے، ۶- «وفي الركاز الخمس» کی تفسیر میں مالک کہتے ہیں: «رکاز» اہل جاہلیت کا دفینہ ہے اگر کسی کو جاہلیت کا دفینہ ملے تو وہ پانچواں حصہ سلطان کے پاس ( سرکاری خزانہ میں ) جمع کرے گا اور جو باقی بچے گا وہ اس کا ہو گا۔

English Translation

Narrated Abu Hurairah: that the Messenger of Allah (ﷺ) said: The injuries caused by the animal are without liability, and wells are without liability, and mines are without liability, and the Khumus is due on Rikaz. (Another Chain) from Abu Hurairah, from the Prophet (ﷺ) with similar meaning.
