حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ،‏‏‏‏ عَنْ مُجَالِدٍ،‏‏‏‏ عَنْ الشَّعْبِيِّ،‏‏‏‏ عَنْ عَدِيِّ بْنِ حَاتِمٍ،‏‏‏‏ قَالَ:‏‏‏‏ سَأَلْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ صَيْدِ الْكَلْبِ الْمُعَلَّمِ،‏‏‏‏ قَالَ:‏‏‏‏ إِذَا أَرْسَلْتَ كَلْبَكَ الْمُعَلَّمَ،‏‏‏‏ وَذَكَرْتَ اسْمَ اللَّهِ،‏‏‏‏ فَكُلْ مَا أَمْسَكَ عَلَيْكَ،‏‏‏‏ فَإِنْ أَكَلَ فَلَا تَأْكُلْ فَإِنَّمَا أَمْسَكَ عَلَى نَفْسِهِ ،‏‏‏‏ قُلْتُ:‏‏‏‏ يَا رَسُولَ اللَّهِ،‏‏‏‏ أَرَأَيْتَ إِنْ خَالَطَتْ كِلَابَنَا كِلَابٌ أُخَرُ،‏‏‏‏ قَالَ:‏‏‏‏ إِنَّمَا ذَكَرْتَ اسْمَ اللَّهِ عَلَى كَلْبِكَ،‏‏‏‏ وَلَمْ تَذْكُرْ عَلَى غَيْرِهِ ،‏‏‏‏ قَالَ سُفْيَانُ:‏‏‏‏ أَكْرَهُ لَهُ أَكْلَهُ،‏‏‏‏ قَالَ أَبُو عِيسَى:‏‏‏‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ،‏‏‏‏ فِي الصَّيْدِ وَالذَّبِيحَةِ،‏‏‏‏ إِذَا وَقَعَا فِي الْمَاءِ أَنْ لَا يَأْكُلَ،‏‏‏‏ فَقَالَ بَعْضُهُمْ فِي الذَّبِيحَةِ:‏‏‏‏ إِذَا قُطِعَ الْحُلْقُومُ،‏‏‏‏ فَوَقَعَ فِي الْمَاءِ فَمَاتَ فِيهِ،‏‏‏‏ فَإِنَّهُ يُؤْكَلُ،‏‏‏‏ وَهُوَ قَوْلُ عَبْدِ اللَّهِ بْنِ الْمُبَارَكِ،‏‏‏‏ وَقَدِ اخْتَلَفَ أَهْلُ الْعِلْمِ فِي الْكَلْبِ إِذَا أَكَلَ مِنَ الصَّيْدِ،‏‏‏‏ فَقَالَ أَكْثَرُ أَهْلِ الْعِلْمِ:‏‏‏‏ إِذَا أَكَلَ الْكَلْبُ مِنْهُ فَلَا تَأْكُلْ،‏‏‏‏ وَهُوَ قَوْلُ سُفْيَانَ،‏‏‏‏ وَعَبْدِ اللَّهِ بْنِ الْمُبَارَكِ،‏‏‏‏ وَالشَّافِعِيِّ،‏‏‏‏ وَأَحْمَدَ،‏‏‏‏ وَإِسْحَاق،‏‏‏‏ وَرَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ،‏‏‏‏ فِي الْأَكْلِ مِنْهُ،‏‏‏‏ وَإِنْ أَكَلَ الْكَلْبُ مِنْهُ.

Urdu Translation

عدی بن حاتم رضی الله عنہ کہتے ہیں کہ   میں نے رسول اللہ صلی اللہ علیہ وسلم سے سدھائے ہوئے کتے کے متعلق پوچھا تو آپ نے فرمایا: ”جب تم اپنا سدھایا ہوا کتا روانہ کرو، اور ( بھیجتے وقت اس پر ) اللہ کا نام ( یعنی بسم اللہ ) پڑھ لو تو تمہارے لیے جو کچھ وہ روک رکھے اسے کھاؤ اور اگر وہ شکار سے کچھ کھا لے تو مت کھاؤ، اس لیے کہ اس نے شکار اپنے لیے روکا ہے“، میں نے عرض کیا: اللہ کے رسول! آپ کا کیا خیال ہے اگر ہمارے کتے کے ساتھ دوسرے کتے شریک ہو جائیں؟“ آپ نے فرمایا: ”تم نے اللہ کا نام ( یعنی بسم اللہ ) اپنے ہی کتے پر پڑھا ہے دوسرے کتے پر نہیں“۔ سفیان ( ثوری ) کہتے ہیں: آپ نے اس کے لیے اس کا کھانا درست نہیں سمجھا ۱؎۔ امام ترمذی کہتے ہیں: ۱- ذبیحہ اور شکار کے سلسلے میں صحابہ کرام میں سے بعض اہل علم اور دوسرے لوگوں کے نزدیک اسی پر عمل ہے کہ جب وہ پانی میں گر جائیں تو انہیں کوئی نہ کھائے اور بعض لوگ ذبیحہ کے بارے میں کہتے ہیں: جب اس کا گلا کاٹ دیا جائے، پھر پانی میں گرے اور مر جائے تو اسے کھایا جائے گا، عبداللہ بن مبارک کا یہی قول ہے، ۲- اہل علم کا اس مسئلہ میں کہ جب کتا شکار کا کچھ حصہ کھا لے اختلاف ہے، اکثر اہل علم کہتے ہیں: جب کتا شکار سے کھا لے تو اسے مت کھاؤ، سفیان ثوری، عبداللہ بن مبارک، شافعی، احمد اور اسحاق بن راہویہ کا یہی قول ہے، ۳- جب کہ صحابہ کرام میں سے بعض اہل علم اور دوسرے لوگوں نے کھانے کی رخصت دی ہے، اگرچہ اس میں سے کتے نے کھا لیا ہو۔

English Translation

Narrated 'Adi bin Hatim: I asked the Messenger of Allah (ﷺ) about the game caught by a trained dog. He said: 'If you mention the Name of Allah when you send your trained dog, then eat from what it catches for you. But if it eats from it, then do not eat it, for he only caught it for himself.' I said: 'O Messenger of Allah! What do you say about when our dogs get mixed with other dogs.' He said: 'You only mentioned the Name of Allah over your dog, you did not mention it over the others.' Sufyan said: He disliked for him to eat it.
