حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا بِشْرُ بْنُ الْمُفَضَّلِ، عَنْ مُحَمَّدِ بْنِ زَيْدٍ، عَنْ عُمَيْرٍ مَوْلَى آبِي اللَّحْمِ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ شَهِدْتُ خَيْبَرَ مَعَ سَادَتِي، ‏‏‏‏‏‏فَكَلَّمُوا فِيَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏وَكَلَّمُوهُ أَنِّي مَمْلُوكٌ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ فَأَمَرَ بِي، ‏‏‏‏‏‏فَقُلِّدْتُ السَّيْفَ، ‏‏‏‏‏‏فَإِذَا أَنَا أَجُرُّهُ، ‏‏‏‏‏‏فَأَمَرَ لِي بِشَيْءٍ مِنْ خُرْثِيِّ الْمَتَاعِ، ‏‏‏‏‏‏وَعَرَضْتُ عَلَيْهِ رُقْيَةً كُنْتُ أَرْقِي بِهَا الْمَجَانِينَ، ‏‏‏‏‏‏فَأَمَرَنِي بِطَرْحِ بَعْضِهَا وَحَبْسِ بَعْضِهَا ، ‏‏‏‏‏‏وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ ابْنِ عَبَّاسٍ، ‏‏‏‏‏‏وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏لَا يُسْهَمُ لِلْمَمْلُوكِ، ‏‏‏‏‏‏وَلَكِنْ يُرْضَخُ لَهُ بِشَيْءٍ، ‏‏‏‏‏‏وَهُوَ قَوْلُ الثَّوْرِيِّ، ‏‏‏‏‏‏وَالشَّافِعِيِّ، ‏‏‏‏‏‏وَأَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق.

Urdu Translation

عمیر مولیٰ ابی اللحم رضی الله عنہما کہتے ہیں کہ   میں اپنے مالکان کے ساتھ غزوہ خیبر میں شریک ہوا، انہوں نے رسول اللہ صلی اللہ علیہ وسلم سے میرے سلسلے میں گفتگو کی اور آپ کو بتایا کہ میں غلام ہوں، چنانچہ آپ نے حکم دیا اور میرے جسم پر تلوار لٹکا دی گئی، میں ( کوتاہ قامت ہونے اور تلوار کے بڑی ہونے کے سبب ) اسے گھسیٹتا تھا، آپ نے میرے لیے مال غنیمت سے کچھ سامان دینے کا حکم دیا، میں نے آپ کے سامنے وہ دم، جھاڑ پھونک پیش کیا جس سے میں دیوانوں کو جھاڑ پھونک کرتا تھا، آپ نے مجھے اس کا کچھ حصہ چھوڑ دینے اور کچھ یاد رکھنے کا حکم دیا ۱؎۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن صحیح ہے، ۲- اس باب میں ابن عباس رضی الله عنہما سے بھی روایت ہے، ۳- بعض اہل علم کا اسی پر عمل ہے کہ غلام کو حصہ نہیں ملے گا البتہ عطیہ کے طور پر اسے کچھ دیا جائے گا، ثوری، شافعی، احمد اور اسحاق بن راہویہ کا بھی یہی قول ہے۔

English Translation

Narrated 'Umair, the freed slave of Abil-Lahm: I participated at Khaibar with my masters. They spoke about me to the Messenger of Allah (ﷺ) and told him that I was a slave. He said: So he ordered me to take up the sword, and I found myself dragging it, so he ordered that I be given something from the goods. I presented a Ruqyah that I used to treat the possessed with, so he ordered me leave some of it and keep some of it. There is something on this topic from Ibn 'Abbas. This Hadith is Hasan Sahih. This is acted upon according to the some of the people of knowledge. A complete portion is not given to slave, but something is conferred upon him. This is the view of Ath-Thawri, Ash-Shafi'i, Ahmad, and Ishaq.
