Baab Kahanat Aur Bud Faali Se Mutaliq Ehkaam O Masail

حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا ابْنُ لَهِيعَةَ، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ:‏‏‏‏ أَيُّمَا رَجُلٍ عَاهَرَ بِحُرَّةٍ أَوْ أَمَةٍ، ‏‏‏‏‏‏فَالْوَلَدُ وَلَدُ زِنَا لَا يَرِثُ وَلَا يُورَثُ ، ‏‏‏‏‏‏قَالَ أَبُو عِيسَى:‏‏‏‏ وَقَدْ رَوَى غَيْرُ ابْنِ لَهِيعَةَ هَذَا الْحَدِيثَ، ‏‏‏‏‏‏عَنْ عَمْرِو بْنِ شُعَيْبٍ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ:‏‏‏‏ أَنَّ وَلَدَ الزِّنَا لَا يَرِثُ مِنْ أَبِيهِ.

Urdu Translation

عبداللہ بن عمرو رضی الله عنہما سے روایت ہے کہ   رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”جو شخص کسی آزاد عورت یا کسی لونڈی کے ساتھ زنا کرے تو ( اس سے پیدا ہونے والا ) لڑکا ولد الزنا ہو گا، نہ وہ ( اس زانی کا ) وارث ہو گا۔ نہ زانی ( اس کا ) وارث ہو گا“۔ امام ترمذی کہتے ہیں: ۱- ابن لہیعہ کے علاوہ دوسرے لوگوں نے بھی اس حدیث کو عمرو بن شعیب سے روایت کیا ہے، ۲- اہل علم کا اسی پر عمل ہے کہ ولد الزنا اپنے باپ کا وارث نہیں ہو گا۔

English Translation

Amr bin Su'aib narrated from his father, from his grandfather, that the Messenger of Allah(S.A.W) said: Any man who fornicates with a free woman, or a slave woman, then the child born from Zina does not inherit, nor is it inherited from.
