حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا عَبْثَرُ بْنُ الْقَاسِمِ، عَنْ أَشْعَثَ، عَنْ مُحَمَّدٍ، عَنْ نَافِعٍ، عَنْ ابْنِ عُمَرَ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ مَنْ مَاتَ وَعَلَيْهِ صِيَامُ شَهْرٍ فَلْيُطْعَمْ عَنْهُ مَكَانَ كُلِّ يَوْمٍ مِسْكِينًا . قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ ابْنِ عُمَرَ لَا نَعْرِفُهُ مَرْفُوعًا إِلَّا مِنْ هَذَا الْوَجْهِ، ‏‏‏‏‏‏وَالصَّحِيحُ عَنْ ابْنِ عُمَرَ مَوْقُوفٌ قَوْلُهُ، ‏‏‏‏‏‏وَاخْتَلَفَ أَهْلُ الْعِلْمِ فِي هَذَا الْبَاب، ‏‏‏‏‏‏فَقَالَ بَعْضُهُمْ، ‏‏‏‏‏‏يُصَامُ عَنِ الْمَيِّتِ، ‏‏‏‏‏‏وَبِهِ يَقُولُ أَحْمَدُ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏قَالَا:‏‏‏‏ إِذَا كَانَ عَلَى الْمَيِّتِ نَذْرُ صِيَامٍ يَصُومُ عَنْهُ، ‏‏‏‏‏‏وَإِذَا كَانَ عَلَيْهِ قَضَاءُ رَمَضَانَ أَطْعَمَ عَنْهُ، ‏‏‏‏‏‏وقَالَ مَالِكٌ، ‏‏‏‏‏‏وَسُفْيَانُ، ‏‏‏‏‏‏وَالشَّافِعِيُّ:‏‏‏‏ لَا يَصُومُ أَحَدٌ عَنْ أَحَدٍ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ وَأَشْعَثُ هُوَ ابْنُ سَوَّارٍ، ‏‏‏‏‏‏وَمُحَمَّدٌ هُوَ عِنْدِي ابْنُ عَبْدِ الرَّحْمَنِ بْنِ أَبِي لَيْلَى.

Urdu Translation

عبداللہ بن عمر رضی الله عنہما سے روایت ہے کہ   نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”جو اس حالت میں مرے کہ اس پر ایک ماہ کا روزہ باقی ہو تو اس کی طرف سے ہر دن کے بدلے ایک مسکین کو کھانا کھلایا جائے“۔ امام ترمذی کہتے ہیں: ۱- ابن عمر رضی الله عنہما کی حدیث کو ہم صرف اسی سند سے مرفوع جانتے ہیں، ۲- صحیح بات یہ ہے کہ یہ ابن عمر رضی الله عنہما سے موقوف ہے یعنی انہیں کا قول ہے، ۳- اس بارے میں اہل علم کا اختلاف ہے۔ بعض کہتے ہیں کہ میت کی طرف سے روزے رکھے جائیں گے۔ یہ قول احمد اور اسحاق بن راہویہ کا ہے۔ یہ دونوں کہتے ہیں: جب میت پر نذر والے روزے ہوں تو اس کی طرف سے روزہ رکھا جائے گا، اور جب اس پر رمضان کی قضاء واجب ہو تو اس کی طرف سے مسکینوں اور فقیروں کو کھانا کھلایا جائے گا، مالک، سفیان اور شافعی کہتے ہیں کہ کوئی کسی کی طرف سے روزہ نہیں رکھے گا۔

English Translation

Ibn Umar narrated that : the Prophet said: Whoever died while he had a month to fast, then a needy person should be fed on his behalf in place of every day.
