حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا ابْنُ أَبِي عَدِيٍّ، قَالَ:‏‏‏‏ أَنْبَأَنَا حُمَيْدٌ الطَّوِيلُ، عَنْ أَنَسِ بْنِ مَالِكٍ، قَالَ:‏‏‏‏ كَانَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَعْتَكِفُ فِي الْعَشْرِ الْأَوَاخِرِ مِنْ رَمَضَانَ فَلَمْ يَعْتَكِفْ عَامًا، ‏‏‏‏‏‏فَلَمَّا كَانَ فِي الْعَامِ الْمُقْبِلِ اعْتَكَفَ عِشْرِينَ . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ، ‏‏‏‏‏‏مِنْ حَدِيثِ أَنَسِ بْنِ مَالِكٍ، ‏‏‏‏‏‏وَاخْتَلَفَ أَهْلُ الْعِلْمِ فِي الْمُعْتَكِفِ إِذَا قَطَعَ اعْتِكَافَهُ قَبْلَ أَنْ يُتِمَّهُ عَلَى مَا نَوَى، ‏‏‏‏‏‏فَقَالَ بَعْضُ أَهْلِ الْعِلْمِ:‏‏‏‏ إِذَا نَقَضَ اعْتِكَافَهُ وَجَبَ عَلَيْهِ الْقَضَاءُ، ‏‏‏‏‏‏وَاحْتَجُّوا بِالْحَدِيثِ، ‏‏‏‏‏‏أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَرَجَ مِنَ اعْتِكَافِهِ فَاعْتَكَفَ عَشْرًا مِنْ شَوَّالٍ وَهُوَ قَوْلُ مَالِكٍ، ‏‏‏‏‏‏وقَالَ بَعْضُهُمْ:‏‏‏‏ إِنْ لَمْ يَكُنْ عَلَيْهِ نَذْرُ اعْتِكَافٍ أَوْ شَيْءٌ أَوْجَبَهُ عَلَى نَفْسِهِ، ‏‏‏‏‏‏وَكَانَ مُتَطَوِّعًا فَخَرَجَ فَلَيْسَ عَلَيْهِ أَنْ يَقْضِيَ إِلَّا أَنْ يُحِبَّ ذَلِكَ اخْتِيَارًا مِنْهُ، ‏‏‏‏‏‏وَلَا يَجِبُ ذَلِكَ عَلَيْهِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ الشَّافِعِيِّ، ‏‏‏‏‏‏قَالَ الشَّافِعِيُّ:‏‏‏‏ فَكُلُّ عَمَلٍ لَكَ أَنْ لَا تَدْخُلَ فِيهِ، ‏‏‏‏‏‏فَإِذَا دَخَلْتَ فِيهِ فَخَرَجْتَ مِنْهُ فَلَيْسَ عَلَيْكَ أَنْ تَقْضِيَ إِلَّا الْحَجَّ وَالْعُمْرَةَ، ‏‏‏‏‏‏وَفِي الْبَاب عَنْ أَبِي هُرَيْرَةَ.

Urdu Translation

انس بن مالک رضی الله عنہ کہتے ہیں کہ   نبی اکرم صلی اللہ علیہ وسلم رمضان کے آخری عشرے میں اعتکاف کرتے تھے، ایک سال آپ اعتکاف نہیں کر سکے تو جب اگلا سال آیا تو آپ نے بیس دن کا اعتکاف کیا۔ امام ترمذی کہتے ہیں: ۱- انس بن مالک کی یہ حدیث حسن صحیح غریب ہے، ۲- معتکف جب اپنا اعتکاف اس مدت کے پورا کرنے سے پہلے ختم کر دے جس کی اس نے نیت کی تھی تو اس بارے میں اہل علم کا اختلاف ہے، بعض اہل علم نے کہا: جب وہ اعتکاف توڑ دے تو اس پر قضاء واجب ہو گی انہوں نے اس حدیث سے دلیل پکڑی ہے جس میں ہے کہ نبی اکرم صلی اللہ علیہ وسلم اپنے اعتکاف سے نکل آئے تو آپ نے شوال میں دس دن کا اعتکاف کیا، یہ مالک کا قول ہے۔ اور بعض کہتے ہیں: اگر اس پر اعتکاف کی نذر یا کوئی ایسی چیز نہ ہو جسے اس نے اپنے اوپر واجب کر لی ہو اور وہ نفل کی نیت سے اعتکاف میں رہا ہو پھر اعتکاف سے نکل آیا ہو تو اس پر قضاء واجب نہیں الا یہ کہ وہ اپنی پسند سے اسے چاہے اور یہ اس پر واجب نہیں ہو گا۔ یہی شافعی کا قول ہے، ۳- شافعی کہتے ہیں: ہر وہ عمل جس کے کرنے یا نہ کرنے کے سلسلے میں تمہیں اختیار ہو جب تم اسے کرنا شروع کر دو پھر اس کے پورا ہونے سے پہلے تم اسے چھوڑ دو تو اس کی قضاء تم پر لازم نہیں ہے۔ سوائے حج اور عمرہ کے، ۳- اس باب میں ابوہریرہ رضی الله عنہ سے بھی روایت ہے۔

English Translation

Anas bin Malik narrated: The Prophet would perform I'tikaf during the last ten (nights) of Ramadan. One year he did not perform I'tikaf, so he performed I'tikaf for twenty (nights) in the following year.
