حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا هُشَيْمٌ، أَخْبَرَنَا يَزِيدُ بْنُ أَبِي زِيَادٍ، عَنْ ابْنِ أَبِي نُعْمٍ، عَنْ أَبِي سَعِيدٍ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏قَالَ:‏‏‏‏ يَقْتُلُ الْمُحْرِمُ:‏‏‏‏ السَّبُعَ الْعَادِيَ وَالْكَلْبَ الْعَقُورَ وَالْفَأْرَةَ وَالْعَقْرَبَ وَالْحِدَأَةَ وَالْغُرَابَ . قَالَ أَبُو عِيسَى:‏‏‏‏ هَذَا حَدِيثٌ حَسَنٌ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ، ‏‏‏‏‏‏قَالُوا:‏‏‏‏ الْمُحْرِمُ يَقْتُلُ السَّبُعَ الْعَادِيَ، ‏‏‏‏‏‏وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ، ‏‏‏‏‏‏وَالشَّافِعِيِّ، ‏‏‏‏‏‏وقَالَ الشَّافِعِيُّ:‏‏‏‏ كُلُّ سَبُعٍ عَدَا عَلَى النَّاسِ أَوْ عَلَى دَوَابِّهِمْ فَلِلْمُحْرِمِ قَتْلُهُ.

Urdu Translation

ابو سعید خدری رضی الله عنہ سے روایت ہے کہ   نبی اکرم صلی اللہ علیہ وسلم نے فرمایا: ”محرم سرکش درندے، کاٹ کھانے والے کتے، چوہا، بچھو، چیل اور کوے مار سکتا ہے“۔ امام ترمذی کہتے ہیں: ۱- یہ حدیث حسن ہے، ۲- اہل علم کا اسی پر عمل ہے۔ وہ کہتے ہیں: محرم ظلم ڈھانے والے درندوں کو مار سکتا ہے، سفیان ثوری اور شافعی کا بھی یہی قول ہے۔ شافعی کہتے ہیں: محرم ہر اس درندے کو جو لوگوں کو یا جانوروں کو ایذاء پہنچائے، مار سکتا ہے۔

English Translation

Abu Sa'eed narrated that: The Prophet said: The Muhrim may kill the wild beast of prey, the rabid dog, the mouse, the scorpion, the kite, and the crow.
