زِيَادُ بْنُ أَيُّوبَ الْبَغْدَادِيُّ، حَدَّثَنَا عَبَّادُ بْنُ عَوَّامٍ، عَنْ هِلَالِ بْنِ خَبَّابٍ، عَنْ عِكْرِمَةَ، عَنْ ابْنِ عَبَّاسٍ، أَنَّ ضُبَاعَةَ بِنْتَ الزُّبَيْرِ أَتَتِ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، ‏‏‏‏‏‏فَقَالَتْ:‏‏‏‏ يَا رَسُولَ اللَّهِ إِنِّي أُرِيدُ الْحَجَّ أَفَأَشْتَرِطُ ؟ قَالَ:‏‏‏‏ نَعَمْ ، ‏‏‏‏‏‏قَالَتْ:‏‏‏‏ كَيْفَ أَقُولُ ؟ قَالَ:‏‏‏‏ قُولِي:‏‏‏‏ لَبَّيْكَ اللَّهُمَّ لَبَّيْكَ لَبَّيْكَ، ‏‏‏‏‏‏مَحِلِّي مِنَ الْأَرْضِ حَيْثُ تَحْبِسُنِي . قَالَ:‏‏‏‏ وَفِي الْبَاب، ‏‏‏‏‏‏عَنْ جَابِرٍ، ‏‏‏‏‏‏وَأَسْمَاءَ بِنْتِ أَبِي بَكْرٍ، ‏‏‏‏‏‏وَعَائِشَةَ. قَالَ أَبُو عِيسَى:‏‏‏‏ حَدِيثُ ابْنِ عَبَّاسٍ حَدِيثٌ حَسَنٌ صَحِيحٌ، ‏‏‏‏‏‏وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ يَرَوْنَ الِاشْتِرَاطَ فِي الْحَجِّ، ‏‏‏‏‏‏وَيَقُولُونَ:‏‏‏‏ إِنِ اشْتَرَطَ فَعَرَضَ لَهُ مَرَضٌ أَوْ عُذْرٌ، ‏‏‏‏‏‏فَلَهُ أَنْ يَحِلَّ وَيَخْرُجَ مِنْ إِحْرَامِهِ، ‏‏‏‏‏‏وَهُوَ قَوْلُ:‏‏‏‏ الشَّافِعِيِّ، ‏‏‏‏‏‏وَأَحْمَدَ، ‏‏‏‏‏‏وَإِسْحَاق، ‏‏‏‏‏‏وَلَمْ يَرَ بَعْضُ أَهْلِ الْعِلْمِ الِاشْتِرَاطَ فِي الْحَجِّ، ‏‏‏‏‏‏وَقَالُوا:‏‏‏‏ إِنِ اشْتَرَطَ فَلَيْسَ لَهُ أَنْ يَخْرُجَ مِنْ إِحْرَامِهِ، ‏‏‏‏‏‏وَيَرَوْنَهُ كَمَنْ لَمْ يَشْتَرِطْ.

Urdu Translation

عبداللہ بن عباس رضی الله عنہما کہتے ہیں کہ   ضباعہ بنت زبیر نے نبی اکرم صلی اللہ علیہ وسلم کے پاس آ کر کہا: اللہ کے رسول! میں حج کا ارادہ رکھتی ہوں، تو کیا میں شرط لگا سکتی ہوں؟ ( کہ اگر کوئی عذر شرعی لاحق ہوا تو احرام کھول دوں گی ) آپ نے فرمایا: ”ہاں، تو انہوں نے پوچھا: میں کیسے کہوں؟ آپ نے فرمایا: «لبيك اللهم لبيك لبيك محلي من الأرض حيث تحبسني» ”حاضر ہوں اے اللہ حاضر ہوں حاضر ہوں، میرے احرام کھولنے کی جگہ وہ ہے جہاں تو مجھے روک دے“۔ امام ترمذی کہتے ہیں: ۱- ابن عباس رضی الله عنہما کی حدیث حسن صحیح ہے، ۲- اس باب میں جابر، اسماء بنت ابی بکر اور عائشہ رضی الله عنہم سے بھی احادیث آئی ہیں، ۳- اسی پر بعض اہل علم کا عمل ہے، وہ حج میں شرط لگا لینے کو درست سمجھتے ہیں۔ وہ کہتے ہیں کہ اگر اس نے شرط کر لی پھر اسے کوئی مرض یا عذر لاحق ہوا تو اس کے لیے جائز ہے کہ وہ حلال ہو جائے اور اپنے احرام سے نکل آئے۔ یہی شافعی، احمد اور اسحاق بن راہویہ کا بھی قول ہے، ۴- بعض اہل علم حج میں شرط لگانے کے قائل نہیں ہیں۔ وہ کہتے ہیں کہ اگر اس نے شرط لگا بھی لی تو اسے احرام سے نکلنے کا حق نہیں، یہ لوگ اسے اس شخص کی طرح سمجھتے ہیں جس نے شرط نہیں لگائی ہے ۱؎۔

English Translation

Ibn Abbas narrated: Duba'ah bint Az-Zubair came to the prophet and said: 'O Messenger of Allah! I want to perform Hajj so should I state a condition?' He said: 'Yes.' She asked: 'So how should I say it?' He said: 'Say; Labbaik Allahumma labbaika mahilli minal Ard haithu tahbisuni (I respond to Your call O Allah, I respond to Your call, I will exit Ihram any where on the earth where You prevent me.
