Baab Nikah Ke Masail Ka Bayan

حَدَّثَنَا مُحَمَّدُ بْنُ سَلَامٍ ، أَخْبَرَنَا أَبُو مُعَاوِيَةَ ، عَنْ هِشَامٍ ، عَنْ أَبِيهِ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا ، وَإِنِ امْرَأَةٌ خَافَتْ مِنْ بَعْلِهَا نُشُوزًا أَوْ إِعْرَاضًا ، قَالَتْ : هِيَ الْمَرْأَةُ تَكُونُ عِنْدَ الرَّجُلِ لَا يَسْتَكْثِرُ مِنْهَا فَيُرِيدُ طَلَاقَهَا وَيَتَزَوَّجُ غَيْرَهَا ، تَقُولُ لَهُ : أَمْسِكْنِي وَلَا تُطَلِّقْنِي ، ثُمَّ تَزَوَّجْ غَيْرِي فَأَنْتَ فِي حِلٍّ مِنَ النَّفَقَةِ عَلَيَّ وَالْقِسْمَةِ لِي ، فَذَلِكَ قَوْلُهُ تَعَالَى : فَلا جُنَاحَ عَلَيْهِمَا أَنْ يُصْلِحَا بَيْنَهُمَا صُلْحًا وَالصُّلْحُ خَيْرٌ سورة النساء آية 128 .

Urdu Translation

ہم سے ابن سلام نے بیان کیا، کہا ہم کو ابومعاویہ نے خبر دی، انہیں ہشام بن عروہ نے، انہیں ان کے والد نے اور ان سے عائشہ رضی اللہ عنہا نے   آیت «وإن امرأة خافت من بعلها نشوزا أو إعراضا‏» ”اور اگر کوئی عورت اپنے شوہر کی طرف سے نفرت اور منہ موڑنے کا خوف محسوس کرے۔“ کے متعلق فرمایا کہ آیت میں ایسی عورت کا بیان ہے جو کسی مرد کے پاس ہو اور وہ مرد اسے اپنے پاس زیادہ نہ بلاتا ہو بلکہ اسے طلاق دینے کا ارادہ رکھتا ہو اور اس کے بجائے دوسری عورت سے شادی کرنا چاہتا ہو لیکن اس کی موجودہ بیوی اس سے کہے کہ مجھے اپنے ساتھ ہی رکھو اور طلاق نہ دو۔ تم میرے سوا کسی اور سے شادی کر سکتے ہو، میرے خرچ سے بھی تم آزاد ہو اور تم پر باری کی بھی کوئی پابندی نہیں تو اس کا ذکر اللہ تعالیٰ کے اس ارشاد میں «فلا جناح عليهما أن يصالحا بينهما صلحا والصلح خير‏» کہ ”پس ان پر کوئی گناہ نہیں اگر وہ آپس میں صلح کر لیں اور صلح بہرحال بہتر ہے۔“

English Translation

Narrated Aisha: regarding the Verse: 'If a wife fears cruelty or desertion on her husband's part ...') (4.128) It concerns the woman whose husband does not want to keep her with him any longer, but wants to divorce her and marry some other lady, so she says to him: 'Keep me and do not divorce me, and then marry another woman, and you may neither spend on me, nor sleep with me.' This is indicated by the Statement of Allah: 'There is no blame on them if they arrange an amicable settlement between them both, and (such) settlement is better. (4.128)
