Baab Talaq Ke Masail Ka Bayan

حَدَّثَنَا سُلَيْمَانُ بْنُ حَرْبٍ ، حَدَّثَنَا شُعْبَةُ ، عَنْ أَنَسِ بْنِ سِيرِينَ ، قَالَ : سَمِعْتُ ابْنَ عُمَرَ ، قَالَ : طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ وَهِيَ حَائِضٌ ، فَذَكَرَ عُمَرُ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ : لِيُرَاجِعْهَا ، قُلْتُ : تُحْتَسَبُ ، قَالَ : فَمَهْ . وَعَنْ قَتَادَةَ ، عَنْ يُونُسَ بْنِ جُبَيْرٍ ، عَنْ ابْنِ عُمَرَ ، قَالَ : مُرْهُ فَلْيُرَاجِعْهَا ، قُلْتُ : تُحْتَسَبُ ، قَالَ : أَرَأَيْتَ إِنْ عَجَزَ وَاسْتَحْمَقَ .

Urdu Translation

ہم سے سلیمان بن حرب نے بیان کیا، کہا ہم سے شعبہ نے، ان سے انس بن سیرین نے، کہا کہ میں نے ابن عمر رضی اللہ عنہما سے سنا، انہوں نے کہا کہ   ابن عمر رضی اللہ عنہما نے اپنی بیوی کو حالت حیض میں طلاق دے دی۔ پھر عمر رضی اللہ عنہ نے اس کا ذکر نبی کریم صلی اللہ علیہ وسلم سے کیا، نبی کریم صلی اللہ علیہ وسلم نے اس پر فرمایا کہ چاہیے کہ رجوع کر لیں۔ ( انس رضی اللہ عنہ نے بیان کیا کہ ) میں نے ابن عمر رضی اللہ عنہما سے پوچھا کہ کیا یہ طلاق، طلاق سمجھی جائے گی؟ انہوں نے کہا کہ چپ رہ۔ پھر کیا سمجھی جائے گی؟ اور قتادہ نے بیان کیا، ان سے یونس بن جبیر نے اور ان سے ابن عمر رضی اللہ عنہما نے بیان کیا ( کہ نبی کریم صلی اللہ علیہ وسلم نے ابن عمر رضی اللہ عنہما سے ) فرمایا کہ اسے حکم دو کہ رجوع کر لے ( یونس بن جبیر نے بیان کیا کہ ) میں نے پوچھا، کیا یہ طلاق طلاق سمجھی جائے گی؟ ابن عمر رضی اللہ عنہما نے کہا تو کیا سمجھتا ہے اگر کوئی کسی فرض کے ادا کرنے سے عاجز بن جائے یا احمق ہو جائے۔ تو وہ فرض اس کے ذمہ سے ساقط ہو جائے گا؟ ہرگز نہیں۔

English Translation

Narrated Anas bin Seereen: Ibn `Umar said: I divorced my wife while she was menstruating. `Umar mentioned that to the Prophet . The Prophet said, (to my father), Let your son take her back. I asked (Ibn `Umar), Is such a divorce counted (i.e. as one legal divorce)? Ibn `Umar said, Of course. Narrated Yunus bin Jubair: Ibn `Umar said, The Prophet said to `Umar, 'Order him (Ibn `Umar) to take her back.' I asked, Is such a divorce counted (as one legal divorce)? Ibn `Umar said, What do you think if someone becomes helpless and foolish?
